Kuharski insisted the residents ' rights to sleep at night should <br /> also be considered. <br /> Mrs . Makowske told the Council the Planning Commission had determined <br /> during their hearings that- it would not be unique for St. Anthony to <br /> make the decision. to close the City down at 1 :00 A.M. , since other <br /> communities , such as Eagan,.. have made. that same decision. She does <br /> not believe ..any testimony against the ordinance change demonstrated <br /> an adverse business impact and reminded Councilmen Marks and Enrooth, <br /> who have both served on the Planning Commission, how difficult it has <br /> been in the past for the Commission to formulate :questions,a.which scan" be <br /> answered affirmatively by the applicant for a conditional use permit. <br /> Councilman Marks indicated that it is his desire to leave enough <br /> flexibility in the ordinance so Apache won't be prevented from attract- <br /> ing a desirable restaurant which might want to stay open until 2 :00 <br /> to 2 : 30 A.M. , as one has already done in Apache-. in the past. <br /> Mr. Soth said the Council could .probably establish separate hours for <br /> restaurants in the ordinance but the Mayor had some difficulty with <br /> this , wondering- "how would you determine just what hours would be <br /> desirable for all restaurants?" . He said he had now known the . <br /> restaurant in Apache had been open .past 1 :00 A.M. , but .noted that they <br /> had not continued the practice for long, "probably because it wasn' t <br /> • worth it, or maybe , because they went out of business" . <br /> Councilman Ranallo indicated he sees the main function of shopping <br /> centers is to sell merchandise such as clothing, food and prescriptions , <br /> etc. Councilman Letourneau reminded him that the- only business in <br /> Apache which stays open until 1:00 A.M. is owned by the City and he <br /> speculated it might be better if some of those customers had a place <br /> within walking distance to get a cup of coffee or a bite-:.to .e.at before <br /> driving home . <br /> Councilman Ranallo said he couldn ' t understand why the other Councilmen <br /> were so anxious to make restaurants 24 hour operations which would <br /> generate late night traffic and noise to disturb the residents and he <br /> made the motion which was seconded by Mayor Sundland to approve the <br /> second reading of .Ordinance 1982-006 with only the changes made by <br /> the City Attorney . <br /> ORDINANCE 1982-006 <br /> AN ORDINANCE RELATING TO BUSINESS REGULATIONS; <br /> LIMITING THE HOURS OF OPERATION OF CERTAIN <br /> BUSINESSES ; AMENDING THE 1973 CODE OF ORDINANCES <br /> JBY ADDING A SECTION <br /> Before taking a _vote on'-the..motion Counci'lm'an Marks noted- that Eagan is a <br /> developing community and it is _easier to put on conditions during the <br /> • planning process for any city.
