-3- <br /> Mayor Sundland expressed some concern about the sizes of garages which would be <br /> • built with the 32 townhomes on the site. Several townhome owners in the City had <br /> expressed their wish to have had bigger garages at their presently owned townhomes. <br /> Commissioner Bjorklund responded that the Commission had not discussed that concern, <br /> but did discuss the rezoning proposal at length. <br /> Motion by Councilman Marks and seconded by Councilman Ranallo to pass the first <br /> reading of Ordinance 19857001 which would rezone the 2. 5 acre Walbon property at <br /> the southwest corner of Old Highway 8 and 33rd Avenue N.E. from R-1 , single family <br /> residential , to R-3, multi -family residential . The Old Highway 8 Redevelopment/ <br /> Tax Increment Plan would provide 32 townhomes on the site, as proposed by the <br /> tentative developer, Brighton Development Corporation, and the Council finds, as <br /> did the Planning Commission, that: <br /> 1 . The proposed plat met with the general agreement of the neighbors following <br /> their review of the proposal ; <br /> 2. No one spoke against the rezoning; <br /> 3. The proposed development would eliminate the legal non-conforming, industrial/ <br /> commercial type of land' use now in existence on the property; <br /> 4. Rezoning does address a stated conflict of land users in that area which had <br /> been identified in the City' s Comprehensive Plan; and <br /> 5. The Comprehensive Plan further recommends that the medium density housing be <br /> developed for this area. <br /> Motion carried unanimously, <br /> The Commission representative indicated there had been a lengthy discussion con- <br /> cerning the request from Amoco Oil Company for a 15 foot setback variance for <br /> installation of a canopy and a five foot setback variance for the pump at their <br /> station on the southwest corner of Silver Lake Road and 37th Avenue N.E.. Repre- <br /> sentatives from Amoco Oil Company were present to outline for the Council their <br /> proposed plans for the station. Commissioner Bjorklund explained that after much <br /> discussion, the Commission had recommended approval of the request. <br /> Motion by Councilman Ranallo and seconded by Councilman Marks to grant the request <br /> from Amoco Oil Company for a 10 foot setback variance from the 30 foot setback <br /> required in the City Ordinance which would allow construction of a canopy in con- <br /> junction with the construction of a new gas station to be located at 3700 Silver <br /> Lake Road, finding, as did the Planning Commission, that the following statements <br /> which the proponent had included in their December 26th, 1984 application for the <br /> variance, addressed the hardship aspects required to be considered in granting this <br /> variance. <br /> 1 . On this lot several factors combine to create the conditions necessitating a <br /> variance from the front yard setback requirements on Silver Lake Road. The <br /> frontage on 37th Avenue N.E. (118.8) is extremely narrow for the combined side <br /> yard and front yard setback requirements of 50 feet. The only other manner in <br /> which this facility could be situated (rotating the site plan 90 degrees) <br /> is impractical due to the front yard setback from 37th Avenue. N.E... and the steep <br /> drop off to the railroad tracks. Also, the bridge over the tracks restricts <br /> the access to Silver Lake Road in such a manner to create poor on-site traffic <br /> circulation. The lot tapers- from south to north, thus at the front yard set- <br /> back from 37th Avenue N.E. , the lot is narrower than the frontage indicates . <br />
