Ordinance No 1992-007 ; Re: Storm Water Utility (First <br /> 7 Reading) <br /> 8 <br /> 9 The City Manager advised that the purpose of establishing this <br /> 10 storm water utility fund is when projects need to be done <br /> 11 regarding storm water funds will be available. It is the <br /> 12 feeling of the Council that this type of dedicated fund is <br /> 13 more equitable than assessing benefitted property owners . The <br /> 14 assessments would be very costly for property owners. <br /> 15 <br /> 16 The City Manager felt the proposed rates should be ready by <br /> 17 the time the ordinance receives its second reading. A flat <br /> 18 rate is being proposed for residential property and. a <br /> 19 different charge, such as by acreage, is being considered for <br /> 20 larger properties such as shopping centers and large apartment <br /> 21 buildings . <br /> 22 <br /> 23 A storm drainage plan is mandated by the State of Minnesota. <br /> 24 <br /> 25 The City Manager suggested uses for some of these dedicated <br /> 26 funds could -be the diversion of water going into Silver Lake, <br /> general replacement and repair of roads and possible <br /> 40 replacement of storm sewers, correction of problems <br /> 29 associated with Highcrest , 31st Avenue and the Mirror Lake <br /> 30 spillway, maintenance of Silver Lake and Mirror Lake, future <br /> 31 purchase of land for holding ponds , and installation of <br /> 32 appropriate sewer . system size. The City Manager also noted <br /> 33 that this fund could be used to bond against . <br /> 34 <br /> 35 Dennis Cavanaugh, 2909 St . Anthony Boulevard, drafted a list <br /> 36 of comments and questions regarding the proposed storm water <br /> 37 drainage utility. The draft addressed such matters as the <br /> 38 authority to establish a storm water drainage utility, <br /> 39 expansion of the present taxing authority to cover the <br /> 40 operation of the present sewer system, land use, exemptions , <br /> 41 adjustments , public hearing notices, need for this utility, <br /> 42 establishments of rates for residential and commercial <br /> 43 properties., development of a master storm drainage plan and <br /> 44 disposition of funds received from this utility. <br /> 45 <br /> 46 Mr. Cavanaugh was of the opinion that State Statute does not <br /> 47 grant the City the authority to establish a storm water <br /> 48 drainage utility. The City Attorney responded that the statute <br /> 49 authorizes various utilities and drainage utilities and <br /> 50 charges for same. <br />
