REGULAR COUNCIL MEETING <br /> SEPTEMBER 22 , 1992 <br /> 3 PAGE 6 <br /> 4 <br /> 5 <br /> 6 <br /> 7 Councilmember Wagner requested that the City Attorney check <br /> 8 with the School District on this matter . <br /> 9 <br /> 10 Motion by Marks , second by Wagner to approve the second <br /> 11 reading of Resolution No . 1992-008 , being the St . Anthony Sign <br /> 12 Ordinance . <br /> 13 <br /> 14 Motion carried unanimously <br /> 15 <br /> 16 <br /> 17 B. Ordinance No. 1992-009 , Re : Housing Maintenance Code <br /> 18 (Second reading) <br /> 19 <br /> 20 The City Manager advised that the letter from the City <br /> 21 Attorney regarding this ordinance was left out of the agenda <br /> 22 packet . <br /> 23 <br /> 24 He also noted that this draft ordinance is nearly a complete <br /> 25 duplication of the State Statute and it probably should be <br /> 6 decreased in size. <br /> 8 The City Attorney stated he made no attempt at this time to <br /> 29 reduce the size of the ordinance. His purpose in waiting was <br /> 30 to retain all of the content of the State Statute until he <br /> 31 received direction from the City Council . He agreed that a <br /> 32 reduction of the ordinance would make it more manageable . <br /> 33 <br /> 34 Mayor Ranallo expressed a concern with the reduction of the <br /> 35 ordinance . He suggested it may prohibit residents from having <br /> 36 all information available regarding ordinances . He questioned <br /> 37 if a reduced ordinance would be sufficient . The City Attorney <br /> 38 agreed that this was a valid point but he had noticed that <br /> 39 some sections of the ordinance appear to overlap. <br /> 40 <br /> 41 Mayor Ranallo stated he has received calls from residents who <br /> 42 were concerned with tree branches and bushes in the neighbor ' s <br /> 43 yard which encroach onto private property. He questioned if <br /> 44 Subsection 13 on page 17 of the ordinance would address this <br /> 45 problem. <br /> 46 <br /> 47 The City Attorney responded that this subsection would not <br /> 48 apply and the example given by the Mayor is really a private <br /> 49 matter between neighbors . <br /> 50 <br /> • <br />
