1 REGULAR COUNCIL MEETING <br /> OCTOBER 27 , 1992 <br /> PAGE 6 <br /> 4 <br /> 5 <br /> 6 The City Manager felt the public hearing requirements were met <br /> 7 with the public hearing held by the Planning Commission . <br /> 8 ' <br /> 9 Motion by Wagner, second by Enrooth to approve the first <br /> 10 reading of the ordinance which would rezone the aforementioned <br /> 11 parcels on Kenzie Terrace from C to R-1 . <br /> 12 <br /> 13 Roll call : Enrooth, Fleming, Wagner, Ranallo - aye <br /> 14 Marks - not present <br /> 15 <br /> 16 2 . Sidevard Setback Variance Request - John Novak, .2608 West <br /> 17 Armour Terrace <br /> 18 <br /> 19 Commissioner Werenicz advised that Mr. Novak is requesting a <br /> 20 variance of one foot , four inches to accommodate the enlarging <br /> 21 of his garage. Mr. Novak wishes to make space for two vehicles <br /> 22 and be able to attach the garage to the house. <br /> 23 <br /> 24 Commissioner Werenicz noted that some members of the Planning <br /> 25 Commission had felt the strict letter of the law be adhered to <br /> 26 but recognized the legitimacy of Mr . Novak ' s request . <br /> 27 <br /> Regarding the hardship factor for granting the request , <br /> is members of the Commission suggested that the ordinance may be <br /> 30 what is creating the hardship. It was felt by Commission <br /> 31 members that perhaps all of the parking ordinances should be <br /> 32 reviewed. The Planning Commission recommended the granting of <br /> 33 the variance request on a vote of. five to two on the condition <br /> 34 that the property lines be clearly defined. <br /> 35 <br /> 36 Commissioner Werenicz advised that the neighbor to the east of <br /> 37 Mr. Novak, John Dotolo, expressed concern regarding the exact <br /> 38 property lines . The City Manager noted that a survey is not <br /> 39 being requested, but rather that the lot lines be identified <br /> 40 and the monument stakes be found. This would also impact on <br /> 41 the variance. <br /> 42 - <br /> 43 Councilmember Fleming inquired if Mr. Dotolo has signed the <br /> 44 memo from the neighbors which stated they had no problem with <br /> 45 the granting of the variance. Mr. Dotolo . replied he had not <br /> 46 signed the memo and was concerned with a flower bed in h i s <br /> 47 yard which will be affected by this garage enlargement . He <br /> 48 prefers that the garage be left the way it presently is . <br /> 49 <br /> 50 <br />
