1 The City Clerk advised that she wanted two election judges, one from each political <br /> party to attend at the recounting of the ballots. She said that two election judges <br /> 3 are not required by law. <br /> 4 Motion by Faust, second by Marks to appoint Connie Kroeplin, City Clerk for the <br /> 5 City of St. Anthony as the Recount Official for the elections that were held on <br /> 6 November 4, 1997. <br /> 7 Motion carried unanimously. <br /> 8 IV. DISCUSS CANVASSING BOARD. <br /> 9 The Council discussed the composition of the Canvassing Board. Councilmember <br /> 10 Wagner asked that Dale Gunderson, 3525 Chelmsford Road NE, be appointed to <br /> 1.1 replace him-on the Canvassing Board. He stated that because he had requested the <br /> 12 recount of the cast ballots, he felt he should not personally serve on the Canvassing <br /> 13 Board for the recount. Councilmember Enrooth indicated that he did not ask <br /> 14 anyone to represent him on the Canvassing Board. Mayor Ranallo reported that <br /> 15 the City Attorney is available Monday, November 10, 1997 at 2:00 p.m. for the <br /> 16 recounting procedure. <br /> 17 Brian Thuesen, candidate for City Council, requested a clarification of the duties of <br /> 18 the Canvassing Board. Mayor Ranallo responded that the Canvassing Board for the <br /> 69 recounting of the cast ballots will observe the recounting and convene after the <br /> �j recount is completed to vote to accept or not accept the results of the recounted <br /> 21 ballots. The impartiality of the Councilmembers sitting as the Canvassing Board <br /> 22 was questioned. Mayor Ranallo stated that Councilmembers Faust, Marks and he <br /> 23 would they realize a benefit from the results of the recount, simply because they <br /> 24 had not been candidates in this City election. <br /> 25 Brian Rice, Best & Flanagan Law Firm, stated to the Council that he will be <br /> 26 representing Mr. Thuesen in the recount. He agreed that City Councils are the <br /> 27 Canvassing Boards for elections. He questioned the issue of Councilmembers <br /> 28 appointing someone to sit on the Canvassing Board. Mr. Rice suggested that the <br /> 29 City may want to verify this with the City Attorney. He said he knew of no other <br /> 30 issue where a councilmember can appoint a replacement. <br /> 31 The City Clerk indicated that she had already talked with the Hennepin County <br /> 32 Director of Elections and it was her suggestion that this could be done. Mr. Rice <br /> 33 indicated that he knew Ms. Christianson and acknowledged that she is very <br /> 34 knowledgeable about elections but felt that the City should seek the City <br /> 35 Attorney's counsel on this issue. <br /> 36 Mayor Ranallo advised the Councilmembers that if they planned to appoint a <br /> 37 representative for the recount, they should do so by Monday and advise the City <br /> 48 Clerk. <br />
