Approval of Proposal for Engineering Services for Fuel Tank Replacement. <br /> 3 Mornson reported that in 1997 the Federal Environmental Protection Agency adopted regulations <br /> 4 governing underground storage tanks. All fuel tanks installed before December 1998 that do not <br /> 5 meet the standards must be removed. One such tank which was located by the old Community <br /> 6 Center has been removed. There are existing fuel tanks near the Public Works building which <br /> 7 need to be removed. <br /> 8 Mornson noted the funds for this project are in the City budget. The Minnesota Petro Fund will <br /> 9 reimburse 90% of the cost of the tank removal back to the City provided a contractor who is on <br /> 10 the Pollution Control Agency-list is utilized. Staff is recommending that Nova Environmental <br /> 11 Services, Inc. be hired for this project. <br /> 12 Motion by Marks, second by Faust to retain Nova Environmental Services, Inc. in the amount of <br /> 13 $6,284.00 for the fuel tank replacement at the Public Works building site. <br /> 14 Motion carried unanimously <br /> 15 B. Ordinance 1998-007, re: Cable TV Franchise Term (Waive First 2 Readings and Adopt). <br /> Mayor Ranallo noted that City policy is to have two readings and then adoption of any ordinance <br /> *7 change. This situation is unique in that the City did approve an extension of this ordinance 2-3 <br /> 18 months ago which will expire on April 20, 1998. He explained that Meredith Cable is in the <br /> 19 process of selling the cable company and the company was to be purchased by U.S. West. U.S. <br /> 20 West was not allowed to purchase the cable company as it would infringe on the open policy <br /> 21 regarding cable. U.S. West has since decided to split it's company and include Media One who <br /> 22 would then purchase the cable company. He requested the Council approve this ordinance <br /> 23 amendment to allow the law firm time to continue to make progress on this issue. <br /> 24 Motion by Marks, second by Thuesen to waive the first two readings and adopt Ordinance 1998- <br /> 25 007, an ordinance amending Cable Franchise Ordinance 1982-009, Article II., Section 4, <br /> 26 Franchise Term. <br /> 27 Motion carried unanimously. <br /> 28 C. Resolution 98-037, re: Wetland Conservation Act. <br /> 29 Mornson reported this resolution will designate the City of St. Anthony as the administering <br /> 30 agency of the Wetland Conservation Act for the southwest area of the community. <br /> 31 Motion by Marks, second by Faust to approve Resolution 98-037, adopting the permanent rules <br /> 32 of the Wetland Conservation Act. <br /> 0 Motion carried unanimously. <br /> 34 <br />
