Sir: <br /> RE : New Laws Regarding Variances And <br /> Conditional Use Permits <br /> Certain changes in the laws relating to variances and condi- <br /> tional use permits were made in the last session of the Legis- <br /> lature and became effective January 1 , 1983. These are covered <br /> by Laws of Minnesota 1982 , Chapter 507'. <br /> The amendments define "undue hardship" with respect to variances <br /> and establish- certain new requirements for conditional use per <br /> mits. <br /> The Statutes have also. been amended to , require the filing with <br /> the County Recorder or Registrar of Titles of granted variances <br /> and conditional use permits and all zoning ordinances. <br /> I am enclosing for your reference a copy of portions of the new <br /> law. The changes with respect to variances appears on page 593. <br /> The conditional use permit provisions are on pages 594 and 595, <br /> and the recording requirement is on page 595 . <br /> In looking into our existing City Ordinances regarding vari- <br /> ances and conditional use permit procedures, we are relatively <br /> close as general principles apply, but the language used in <br /> the new laws are somewhat different-. I suggest that each city <br /> in the state must now look at their existing ordinances and <br /> consider amendments to deal with the new law. <br /> The recording requirements in- my opinion and that of the St. <br /> Anthony City Council, are placing a burden on both property <br /> owners and cities.
