In addition, each variance <br /> and conditional use permit will have to be carefully drafted <br /> and will need to include a proper legal description and other <br /> necessary elements complying with the cities' ordinances and <br /> the new state laws. (See attached St. Anthony City Council <br /> action) . <br /> I am also attaching a copy of a letter received from Hennepin <br /> County with respect to questions raised in connection with these <br /> filings. As you will note, the variances will not be accepted <br /> by the Registrar of Titles. It will be necessary for the city <br /> or the property owner to determine whether the property is Tor- <br /> rens property or not. It- will also be necessary to provide a <br /> perfectly correct legal description (which in the Torrens pro- <br /> perty must be identical to that which appears on the Certificate <br /> of Title) , and it will be necessary to correctly state the name <br /> of the owner of the property. If the property has been purchased <br /> on contract for deed, it is not clear whether the fee owner or <br /> contract purchaser should be named as the person to whom the <br /> variance or conditional use permit is granted. <br /> As you will further note in the letter from the County, the <br /> County is of the opinion that variances. and conditional use <br /> permits benefit the owner, not the City, and that the exemp- <br /> tion from filing fees available to .cities for recording deeds, <br /> easements , etc. , will therefore not be available in these cases. <br /> Our suggestion is to try and have at least the recording re- <br /> quirements repealed on the ground that they will cause undue <br /> administrative burdens and exPense for cities at a time when <br /> they can least afford it, and alsolon property owners of our <br /> cities. <br /> I will be in Washington D.C . on March 3, 1983, so of course <br /> will not be at the monthly AMM meeting.
