DATE: May 22, 1987 <br /> • TO: Dave Childs; City Manager <br /> FROM: Don Hickerson, Chief of Police <br /> SUBJECT: Changes recommended in ordinances <br /> I recommend that City Ordinance Section 1010:00 - Animals at Large Impounding <br /> be changed as follows: <br /> Section 1010:20 - Notice of Impounding Police Officers shall report <br /> all diseased dogs and animals to the Health Officer <br /> has been deleted. Reason: Dr. William Carr is Health <br /> Officer, and it is very time-consuming to make con- <br /> tact with him, and it can be handled very easily <br /> by the Police Department. <br /> Section 1010:25 - Impounding: .Notice and Claiming All references <br /> - to "Clerk" have been changed to "Police". Reason: <br /> Police are available on holidays and weekends and <br /> there is less chance of error if process is handled <br /> by one department than with multiple departments. <br /> Section 1010:30 - Quarantine All references to "Health Officer" have <br /> been changed to "Police". Reason: For convenience <br /> and one-department processing. <br /> Section 1010:35 - Disposition of Animals. . . <br /> longer period by the "Health Officer" has been changed <br /> to "Police". Reason: Same reasons as above. <br /> Section 1010:35 - Subdivison 2. . "regular business days" shall mean <br /> all days except Saturdays. . .should be changed to <br /> days "meaning a day during which the establishment <br /> having custody of an animal is open to the public, <br /> not less than four consecutive hours between the <br /> hours .of 8:00 a.m. and 7:00 p.m". Reason: This <br /> change will save the City money on those animals <br /> that are not claimed because the Animal Control <br /> Service is open on weekends, and weekends do not <br /> count in the days an animal must be kept under <br /> the present ordinance. This change was made by the <br /> City Attorney and complies with State Statutes. <br /> I recommend that City Ordinance Section 1100 - Penal Offenses, Penalty <br /> Revocation of License be changed as follows: <br /> Section 1100:00 - Penalty for:Violations Subd. 1 Any person violatincr <br /> any of the provisions of this code, "The 1973 Code of <br /> Ordinances of the Village of St. Anthony," shall be <br /> guilty of a misdemeanor, unless expressly stated <br /> • otherwise. - This change makes' the-misdemeanor maxi <br /> mum fine coincide with the Minnesota State Statutes <br /> and makes changes in the fine amount unnecessary in <br /> the future should the State change the' ma.,d man mount. <br />
