3 <br /> SECTION EXEMPTIONS FOR CERTAIN LAND USES <br /> The following land uses are exempt from the surface water management fee: (1) City, <br /> County and State road and highway rights-of-way, (2) lakes and ponds, and (3) City- <br /> owned facilities. <br /> SECTION ADJUSTMENT OF CHARGES <br /> The City Council may by ordinance adopt policies providing for the adjustment of <br /> charges for parcels or groups of parcels, based upon land use data supplied by affected <br /> property owners, which data demonstrates a runoff volume for the standard rainfall event <br /> substantially different from the REF being used for the parcel or parcels. Such <br /> adjustment shall be made only upon recommendation of the Director of Public Works and <br /> shall not be made effective retroactively. <br /> SECTION . PUBLIC HEARING AND NOTICE <br /> The City shall hold a hearing prior to determining whether to build, construct, <br /> enlarge or improve storm sewer facilities financed in whole or in part by the imposition <br /> of storm sewer drainage charges. Notice of such hearing shall be published in the official • <br /> City newspaper at least ten days prior to. the date of hearing. Owners of all property <br /> adjoining a proposed improvement shall be mailed or served with a notice at least ten <br /> days in advance of the hearing. However, failure to give mailed notice or any defects in <br /> the notice shall not invalidate the proceedings. <br /> SECTION . ESTABLISHMENT OF A TAX LIEN <br /> Any past due storm water drainage fees in excess of ninety (90) days past due on <br /> October 1 of any year may be certified to the County Auditor for collection with real estate <br /> taxes in the following year pursuant to Minnesota Statutes, Section 444.075, Subd. 3. In <br /> addition, the City shall have the right to bring a civil action or to take legal remedies to <br /> collect unpaid charges. <br /> SECTION RECALCULATION OF CHARGES <br /> If a property owner or person responsible for paying the storm water drainage <br /> charge questions the correctness of such a charge, such person may have the <br /> determination of the charge recomputed by written request to the Director of Public <br /> Works. Such request shall be made within thirty (30) days of the mailing of the billing in <br /> question. <br />
