He suggested that if there are <br /> 13 any more changes members of the Commission want included they <br /> 14 notify Urbia. Urbia was requested to present the amended by- <br /> 15 laws to the City Council at its December 7th Council meeting. <br /> 16 He also wanted this item on the .December Planning Commission <br /> 17 meeting agenda. <br /> 18 <br /> 19 <br /> 20 F. Separation of Undersized Lots Held in Sinale Ownership <br /> 21 <br /> 22 The resident at 3127 Silver Lake Road approached the City <br /> 23 regarding separation of undersized lots held in . single <br /> 24 ownership. Staff determined this would be a policy issue and <br /> 25 contacted the City Attorney to provide legal insight into the <br /> 26 issue. <br /> 27 <br /> 28 The City Attorney advised by letter that the half-section maps • <br /> 29 for the City should be reviewed to determine whether there <br /> 30 should be an ordinance change requiring single ownership or a <br /> 31 grandfathering provision . <br /> 32 <br /> 33 Staff reviewed the half-section maps and determined there are <br /> 34 a significant number of old plats with very small lots. .Staff <br /> 35 concluded it would be advisable to have an ordinance <br /> 36 prohibiting the separation of legally platted lots if the lots <br /> 37 do not conform to current zoning ordinances when separated. <br /> 38 <br /> 39 Commissioner Franzese felt that some policies should be <br /> 40 formulated as to where the City wants to go with these types <br /> 41 of matters . <br /> 42 <br /> 43 Motion by Franzese that this item be placed on the agenda when <br /> 44 the City Attorney, Bill Soth, will be in attendance. The <br /> 45 motion was withdrawn . <br /> 46 <br /> 47 Chairperson Faust felt the Planning Commission was being <br /> 48 requested j o •develop some kind of philosophy for the City <br /> 49 <br /> 50 <br />
