With the exception of two vehicles stored outdoors for 72 hours only, no outdoor storage <br /> 2 of vehicles was allowed. <br /> 3 3. An enclosure would be constructed around the dumpster. <br /> 4 4. A landscaping and lighting plan would be submitted for staff approval. He noted the <br /> 5 Commission asked for additional plantings to "soften the look,"as most of the current <br /> 6 trees would be lost during construction. <br /> 7 5. Review and approval by the City Attorney and City Engineer were required. He <br /> 8 indicated the Watershed District had been involved with solving some of the drainage <br /> 9 issues. <br /> 10 6. The landscaping plan must be consistent with the surrounding neighborhood. <br /> 11 <br /> 12 Chair Stromberg noted the Commission had reviewed previous conditional use permits on <br /> 13 similar facilities in recent years before making its recommendations. He added the Tires Plus <br /> 14 representatives were open to the conditions. <br /> 15 <br /> 16 Chair Stromberg indicated limiting truck access through the TCF parking lot was also discussed <br /> 17 as a condition; however, the Tires Plus manager felt he could self-regulate the access. <br /> 18 Discussion followed regarding planned access to the proposed Tires Plus location. <br /> 19 <br /> 20 Councilmember Host stated he was concerned about the restriction of hours placed on Tires <br /> 21 Plus. He asked the Tires Plus representatives if this was a surprise to them. One of the <br /> 22 representatives responded it was a surprise,partly because Tires Plus had been a part of the <br /> 23 business community for so many years. He noted Tires Plus gave the Planning Commission its <br /> 24 hours of operation and the Planning Commission had extended the hours a small amount beyond <br /> 25 what Tires Plus had given them. <br /> 26 <br /> 27 Councilmember Faust noted the City restricted hours of operation for Exhaust Pros in 1994; <br /> 28 therefore, this was not the first time it had happened. Councilmember Horst responded he <br /> 29 agreed; however, this was the first time he had been able to object to the restriction. <br /> 30 <br /> 31 The Tires Plus representative indicated flexibility was sometimes needed when it was necessary <br /> 32 to complete work on a customer's car. Councilmember Horst agreed and discussed reasons why <br /> 33 he did not agree with restricting a business to certain hours, especially a business that had been a <br /> 34 "good neighbor." He added the City should at least expand the hours to what was reasonable for <br /> 35 this type of business. <br /> 36 <br /> 37 Discussion followed regarding Tires Plus' current hours of operation and situations that could <br /> 38 demand Tires Plus remain open beyond the recommended hours. <br /> 39 <br /> 40 Councilmember Horst stated he felt it did not hurt Council to be flexible; however, lack of <br /> 41 flexibility could hurt the business. <br /> 42 <br /> 43 Chair Stromberg indicated the Planning Commission's intention was not to hurt Tires Plus' <br /> 44 business. Councilmember Horst responded the condition would hurt Tires Plus' business. <br /> 45 <br />
