City Council Regular Meeting Minutes <br /> March 23, 2004 05 <br /> Page 5 <br /> 1 Discussion followed regarding the need to protect homes located close to a business that worked <br /> 2 on vehicles. <br /> 3 <br /> 4 Councilmember Faust stated he disagreed with Councilmember Horst and noted Tires Plus <br /> 5 would be closer to housing than it was before. He agreed adjustment would be needed if a <br /> 6 business competing with Tires Plus was located nearby and was allowed to stay open. He <br /> 7 indicated this issue needed to be handled with consistency and added he did not foresee the City <br /> 8 "shutting them down"if they stayed open late to take care of one of the City's residents. He <br /> 9 noted this type of business could be noisy in the summer and thought it would be nice to have <br /> 10 "peace and quiet"during some parts of the day. <br /> 11 <br /> 12 Councilmember Horst stated he thought Rapid Oil Change was open until 10:00 p.m. or 11:00 <br /> 13 p.m. He added he knew they were open late on weekends. He agreed the City needed to treat <br /> 14 businesses equally. <br /> 15 <br /> 16 Councilmember Horst stated he did not want the first condition, which restricted hours of <br /> 17 operation, included in the resolution. He noted it would be hard to enforce all conditions if it <br /> 18 was decided one of them could be ignored and he wanted to make the conditional uses realistic. <br /> 19 <br /> 20, Councilmember Faust stated he felt it would be easier to hold the business to a higher standard <br /> 21 that could be relaxed rather than a lesser standard that needed tightening. Councilmember Horst <br /> 22 responded he felt Tires Plus' track record showed they did not need"tightening up." <br /> 23 <br /> 24 Councilmember Thuesen asked if legal issues would surface if the City granted longer hours for <br /> 25 Tires Plus, and Exhaust Pros, for example, did not have the same hours. He questioned if this <br /> 26 was something Council needed to consider or was each situation with conditional use permits <br /> 27 different. <br /> 28 <br /> 29 City Manager Morrison responded every situation was different and one of the issues considered <br /> 30 was the location of the business. He explained the Chair of the Planning Commission would ask <br /> 31 the business what its current hours of operation were, which was done in this case. He noted <br /> 32 flexibility was already shown, as the Planning Commission expanded the hours a small amount <br /> 33 beyond the cited current hours. <br /> 34 <br /> 35 Mr. Momson noted Councilmember Horst had asked what would happen if Wal-Mart offered <br /> 36 tire repair service, which Mr. Morrison felt was probable. He explained that was a separate <br /> 37 issue, as Wal-Mart was zoned PUD; therefore, the hours could be more or less restrictive, <br /> 38 depending on the PUD Agreement. He added, in the Tires Plus situation,the condition involving <br /> 39 hours of operation was to stop any possible disturbances in the neighborhood. <br /> 40 <br /> 41 Councilmember Stille stated he was concerned about outside storage of vehicles. He indicated <br /> 42 he understood the condition was trying to provide some flexibility so Tires Plus would not be in <br /> 43 violation if they did have to leave a vehicle outside at night; however, it was his understanding <br /> 44 the outside storage of vehicles was"avoided at all costs." <br /> 45 <br />
