MEMORANDUM <br /> TO: Mayor-' City 'Council and -City Manager <br /> of the' City of St. Anthony <br /> RE: Proposed Plat of Christen Addition <br /> DATE: July 7, 1981 <br /> We have reviewed .the proposed plat of .Christen Addition, <br /> and the title to the property being platted., as evidenced by three <br /> abstracts of- title, the most recent of which is certified to April <br /> • 29, .1981 7:00 A.M. , by Title- Insurance Company of Minnesota. ' The <br /> following -are our conclusions with- respect to the title and the <br /> plat. <br /> 1. TITLE: .Based upon examination of the plat and the <br /> abstracts, -. we conclude the following: <br /> a. The record fee owners of the property <br /> described in the plat are Flossie Christen, <br /> a single person, - as to a portion of the <br /> property, and Robert L. Christen and <br /> Rosemarie Christen., .as to a portion. of the_ <br /> property. The final plat has been correctly <br /> • prepared for signature by these owners. <br /> b. The property is "subject to the rights of <br /> the public over the West -33 feet thereof" . <br /> In the plat, the West 33 feet is being ' <br /> _ . dedicated as part of County Road No. 136 <br /> (Silver Lake Road) . By letter dated March <br /> 2.6 1981, the County- of Hennepin has <br /> requested dedication of an additional 7 feet <br /> of right .of way in the plat. The.- County's <br /> approval of the plat is also conditioned <br /> on no - additional access to Silver Lake Road. <br /> C. The most current abstract shows that real <br /> estate taxes due and. payablein 1.980 and <br /> prior years are paid; and that the taxes <br /> payable in 1981 on the property owned by <br /> Flossie Christen have been paid, but that <br /> the- taxes payable in 1981 have not been <br /> -paid on the balance of the -property. Since <br /> the abstract was certified before the first <br /> -.half was due. on -May 31, . 1981, the taxes may <br /> -now have been paid. In any case, the taxes . <br /> currently due must be paid- before the plat <br /> can be recorded by the owners. <br />
