• MEMORANDUM <br /> TO: Mayor, City Council and City Manager . <br /> of the City of St. Anthony <br /> RE: Proposed Plat of ,St. Anthony Industrial Park <br /> 2nd Addition <br /> DATE: May 10, 1982 <br /> We have reviewed the proposed plat of _St. Anthony .Industrial <br /> Park 2nd Addition and the title to the property being platted, <br /> as shown by Owner ' s. Duplicate Certificate of Title No. 401452, <br /> a copy of Certificate of Title No. 605481, and a title opinion <br /> from Lindquist & Vennum dated May 6, 1982 . The following are <br /> our conclusions with respect to the title and the plat: <br /> 1. TITLE. Based upon an examination of the plat and the <br /> above described evidence of .title, we conclude that: <br /> a. The record fee owners of the property described <br /> in the plat are Loren E. Swanson and Arlene M., Swanson, <br /> husband and wife. The plat correctly shows. them as <br /> owners. Certificate of Title No. -605481 covers Lot <br /> 4, except the southwest 45 feet thereof, Block 1 , <br /> St. Anthony Industrial Park, Certificate of Title <br /> No. 401452 covers Lot 5, Block 1 , . St. Anthony <br /> Industrial Park, and the title opinion covers the <br /> balance of the property (which is not Torrens) . <br /> b. Lot 5 was subject to a mortgage in favor of Mutual <br /> Trust Life Insurance Company and the mortgage <br /> appears as an encumbrance on Certificate of Title <br /> No. 401452 . We have examined a fully executed <br /> release of that mortgage, and have delivered it to <br /> the attorney for Mr. and Mrs. Swanson for registration. <br /> The mortgagee is not shown on the plat and need not <br /> be so long as the release is filed prior to the <br /> filing of the plat. <br /> C. Lots 4 and 5 are subject to certain restrictions <br /> and covenants relating to the land in' St. Anthony <br /> Industrial Park. <br /> d. Lot 5 is subject to an agreement dated June 9 , <br /> 1981, filed August 11 , 1981 as Document No. 1435923 <br /> between the City and the owners relating to main- <br /> tenance of an unopened portion of the street. <br />
