If appealed to any procedure <br /> other than Step 4 of Article VII, the grievance is not subject to the arbitra- <br /> tion procedure as provided in Step 4 of Article VII. The aggrieved employee <br /> J shall indicate, in writing, which procedure is to be utilized, Step 4 of <br /> Article VII or any other appeal procedure, and shall sign .a statement to the <br /> effect that the choice of any other hearing. precludes the aggrieved employee <br /> J from making a subsequent- appeal. through Step 4 of Article VII. <br />=2 ARTICLE XI CONSTITUTIONAL PROTECTION <br /> Employees shall have the rights granted to all citizens by the United States and <br /> Minnesota State Constitutions. <br />. 11 . 1 Employees will be compensated at one and one-half (.1 -1/2) times the employee' s <br /> regularly scheduled shift. Changes of shifts do not qualify an employee for <br /> overtime under this Article. <br /> 11 . 2 Overtime will be distributed as equally as practicable. <br />_ 11 .3 Overtime refused by employees will , for record purposes under Article 11 .2, <br /> I be considered unpaid overtime worked. <br /> 11 .4 For the purpose of computing overtime compensation, overtime hours worked <br /> shall not be pyramided, compounded or paid twice for the same hours worked. <br /> 11 . 5 Overtime will be calculated to nearest fifteen (.15) minutes. <br /> ARTICLE XII SALARIES (MONTHLY ) <br /> The work schedule for all positions covered by this Agreement shall average fifty-six <br /> (56) hours per week, three hours of which is compensated at one and one-half 0-1/2) <br /> times the hourly rate in accordance with the Federal Fair Labor Standards Act. <br /> Based on the foregoing, monthly salary for firefighter and captain shall be as <br /> follows: <br /> Firefighter 1986 Hourly Rate <br /> After three years $2,405 ( 100%) $9.65 <br /> After two years $2,345 (97.5%) $9.41 <br /> After one year $2, 285 (95%) $9.17 <br /> After six months $2,225 (92. 5%) $8.93 <br /> Start $2,165 (90%) $8.69 <br /> =` Captain $2,510 $10.07 <br />
