11 ;' <br /> • ANIMAL CONTROL SERVICE CONTRACT <br /> THIS AGREEMENT, made and entered into this 1st day of October , 1987, by <br /> and between Animal Control and Management , Inc . , a Minnesota Corporation <br /> hereinafter referred to as "ACM" , and the CITY of St . Anthony , a municipal <br /> corporation , Ramsey/Hennepin Counties , Minnesota, hereinafter referred to <br /> as "CITY" . <br /> WITNESSETH: That ACM, in consideration of the coventants and agreements <br /> of CITY hereinafter contained , hereby coventants with CITY that ACM will <br /> provide. Animal Control Service to CITY pursuant to the following provisions : <br /> 1 . That ACM shall provide picK up service of animals in - CITY in a vehicle <br /> appropriate for the transportation of small animal-s. On-call picK up <br /> service shall be provided Monday through Friday , 7:00 a.m. to 7:00 p .m. <br /> Hours will fluxuate for picK up services on Saturdays , Sundays , and <br /> holidays . Emergency service only on New Year 's Day , Easter Sunday , sCj <br /> ThanKsgiving Day and Christmas Day . Standby emergency service shall 6e L <br /> provided at no extra charge per request of CITY's law enforcement <br /> agency and/or previously specified offical of CITY. After 10:00 p .m. <br /> there will be a $20 charge per picK up . ACM shall provide 1 1/2 hours <br /> of patrol on a weeKly basis . <br /> 2. That ACM shall provide limited patrol for the public and private <br /> • streets of CITY during regular patrol hours for the picK up of animals <br /> found to be in violation of CITY's ordinances . <br /> 3. RCM agrees that patrolling shall be done by competent personnel <br /> trained in the handling of animals . ACM shall not forcibly taKe an <br /> animal from any person unless that person 's animal is in violation of <br /> CITY ordinance and ACM may request assistance of a regular officer of <br /> the CITY at their discretion . <br /> 4. That ACM shall equip , service and maintain all vehicles used for <br /> Animal Control Service with two-way radios or other communication <br /> equipment . <br /> 5. Pursuant to Minnesota 'Statues.., ACM shall impound all animals p icKed up <br /> in CITY at its Animal She-Yter located at 10911 N.E. Radisson Road , <br /> City of Blaine , Minnesota. Said animals shall be confined in a humane <br /> manner for a period of not less than five (5) business days or until <br /> claimed by an owner . Animals not claimed before the expiration of <br /> five (5) business days shall become the property of AGM. If an animal <br /> is not so claimed , RCM may dispose of said animal in a humane maanner , <br /> pursuant to MinnesotalStatues ., <br /> G. When an animal is reclaimed by an owner , ACM shall retain the first <br /> impoundment fee as per local ordinance , or $25, whichever is greater . <br /> On second and consecutive impoundments , ACM shall retain a fee equal <br /> to the first and credit the remainder to the CITY. - ACM shall retain <br /> • all Kennel fees charged to the owner. <br />
