• 7. That ACM shall provide euthanasia service to CITY at no additional <br /> charge . Said service shall be administered by qualified personnel and <br /> the disposal of animal carcasses shall be performed as required by <br /> Minnesota Statutes , Section -35, at no additional charge as long as <br /> current rendering facility is operational . A charge for disposal <br /> would be open to negotiation at that time . <br /> 8. That ACM shall assume all liability for all harm to persons , an i•ima ls , <br /> and property due to its negligence or the negligence of this c`Yt-tria�, <br /> and agrees to defend the performance of this contract , and agrees to <br /> defend any legal actions arising therefrom. ACM shall hold CITY <br /> harmless and provide CITY with proof of public 1 iab it ity •coverage , in <br />_ the amount of $200,000 per each claimed and $600,000 for each <br /> occurance , covering the performance of this contract . further , RCM <br /> will furnish the CITY a certificate of insurnace evidencing statutory <br /> WorKer 's Compensation coverage for all ACM employees . <br /> 9. That during the duration of this contract , ACM shall not , within the <br /> State of Minnesota, d-incriminate against any employee or applicant for <br /> employment because of race , color , creed , national origin , or ancestry <br /> and shall include a similar provision in all subcontracts entered into <br /> for the performance hereof , this paragraph being to comply with the <br /> provisions of Minnesota Statute Section 181 . <br /> • 10. That RCM shall Keep accurate and detailed records of the impounding <br /> and disposition of all animals p icKed up in CITY" and furnish monthly <br /> reports to CITY as to the services performed during the month . That <br /> ACM shall provide uniformed Animal Control Officers and marKed <br /> vehicles . <br /> And CITY, in consideration of said coventants and agreements of ACM <br /> hereinbefore contained , hereby coventants with ACM that CITY will obtain <br /> Animal Control Service from ACM pursuant to the following provisions : <br /> 11 . This Agreement shall cover the period from October 1 , 1987 to December <br /> 31 , 1987 and for one year thereafter commencing January 1 , 1988 and <br /> ending December 31 , 1988. This agreement shall be automatically <br /> renewable from year to year on the last business day of December <br /> unless either party gives notice 90 days prior to the expiration date <br /> that it intends not to renew the Agreement . On or before July 15th , <br /> RCM will submit new proposals to CITY for consideration . <br /> 12. That CITY shall pay to ACM the sum of $166 per month for Animal <br /> Control Service for the period from October 1 , 1987 through December <br /> 31 , 1988. <br /> 13. That all boarding fees for claimed animals shall be retained by ACM. <br /> CITY shall pay a boarding fee in the amount- of $10.00 for each <br /> unclaimed animal . <br /> • 14. That CITY shall pay a boarding fee in the amount of $6.00 per day for <br /> all unclaimed domestic animals quarantined at Animal Shelter by order <br /> of the CITY or local police agency unless paid by owner . <br /> 1 <br />
