-3- <br /> Mrs . Makowske said she is "excited about the possibility of this site <br /> finally being developed" . <br /> • Motion by Mrs . Makowske and seconded by Mr. Bowerman to recommend <br /> Council approval of the preliminary plat for the site presently <br /> identified as Lot 12 , Block 1 , Penrod Addition, for the development <br /> of St. Anthony Court, a 25 unit townhome project , by Sid Johnson as <br /> per drainage and grading drawings signed by Keith Nelson, registered <br /> professional engineer, dated May 1 , 1981 , and site and elevation <br /> plans signed by Gary MacKenzie , architect, dated May 19 , 1981 finding <br /> that no variances to the City Zoning Ordinance will be necessary <br /> and all zoning requirements for an R-3 district have been satisfied <br /> in the proposal. The Commission recommends the plat approval be <br /> contingent upon final approval of the drainage plan by the Rice Creek <br /> Watershed District and compliance with all applicable City and State <br /> codes and ordinances , and further , although not required at this time , <br /> recommends that a "firm option" be demonstrated by Mr. Johnson before <br /> the final platting is approved. The Commission does not recommend <br /> an additional road easement along Silver Lake Road be granted to <br /> Ramsey County. <br /> Motion carried unanimously. <br /> At 9 : 02 P.M. the Chairman opened the public hearing on a petition for <br /> a variance from the City Zoning Ordinance from James P . Danelski <br /> by reading the notice which had been mailed to 15 of the property <br /> owners adjacent to the site. No one except Mr. Danelski appeared <br /> to address the proposal . <br /> Mr. Danelski is requesting a 15 foot side yard setback variance to <br /> the City requirement that side yards adjacent to a street measure <br /> not less than thirty feet for the 15 foot addition to the south side <br /> of his existing home on 33rd Avenue N.E. He said with the addition <br /> he will utilize a passive solar heating concept with a stone fire- <br /> place in the middle of the addition serving as the heat collector <br /> and presented an architect' s booklet which illustrated the concept. <br /> A substantial loss of benefit from the sun will be experienced if <br /> the addition is sited anywhere else on the property , Mr. Danelski <br /> insisted, and he has no other place in his existing structure where <br /> the heat collector can be built. A petition signed by four of <br /> Mr. Danelski ' s neighbors indicated they "have no objections to the <br /> deviation" and the petitioner told the Commission he has talked to <br /> all of his neighbors and foresees no problem getting their written <br /> approval as well. Since his neighbors ' dwellings on both sides are <br /> from 110 to 125 feet from his residence, there will be no problem <br /> with solar accessibility for either property. When told a uniformity <br /> in front yards is maintained all the way down that street, Mr. Danelski <br /> insisted "there are at least two homes which are built closer to the <br /> curb on 33rd than I want to be" . <br /> Mr. Bowerman saw two distinct proposals in the petition; one for a <br /> family room addition, and utilization of passive solar heating <br /> concepts in that addition. He could not perceive where Mr. Danelski <br /> had satisfactorily addressed the condition set for granting such a <br /> variance where it must be demonstrated that "an alleged hardship for <br />
