:r -3- <br /> Motion- by <br /> 3Motion by Mr. Bowerman and .seconded by Mr. Peterson to recommend the <br /> Council grant .a Conditional Use permit to-.Keith Grewe , 1001 Orchard <br /> Avenue ,. under the City. Ordinance amendment which will allow the <br /> • operation of a Tan Me ,. Inc. . body sun - tanning salon in a commercial <br /> district,. specifically the lower level of the Apache Shopping Center , <br /> subject to annual review of the permit and- to the salon meeting all <br /> applicable City , State, and Federal codes . The Planning Commission <br /> finds : <br /> (1) . No one .appeared -at .the Commission hearing to object to the <br /> permit <br /> (2) The proposed service seems to fit in with other types of services <br /> in .Apache. <br /> (3) No problems or complaints about similar operations in other <br /> municipalities . have been reported. <br /> Before voting on the motion, Mrs . Makowske expressed. .some concern <br /> about the type of handouts which the franchise distributes , specifically <br /> the one with the. drawing of an unclothed model. Mr. Grewe said he <br /> has no control over the literature but .recalled: that Mr. Van Meter <br /> had indicated at the last meeting,. "there might have to be some changes <br /> made in the franchise logo" . Mrs . Makowske offered an amendment to <br /> the motion that "granting the permit be subject to any models used <br /> in the literature for the salon being clothed" . <br /> The Chairman indicated he believes the City should trust Mr. Grewe <br /> • not to offend the major portion of his clients - by putting- out <br /> material which they might find offensive and there was no second for <br /> the amendment. <br /> Mr. Bjorklund called the question and the vote to end the debate <br /> was unanimous . <br /> The motion carried unanimously. <br /> Mr. Berg said he hopes to be able to make the modifications to the <br /> proposed Sign Ordinance which were . recommended by the City Attorney <br /> and to have the final draft of the .ordinance ready for Commission <br /> consideration in June. <br /> He then reported the $3 ,200 Letter of Credit which assures landscaping <br /> and fencing requirements for the. Craig & Company- property will be <br /> fulfilled had been cashed in as the Council had directed. However, <br /> the Administrative Assistant reported he has recently learned Kenneth <br /> Lee , who is building behind the property in question, has now <br /> indicated a desire to purchase 12 feet of the .Morris property and <br /> intends to put in the fence between the lots himself if the deal <br /> goes through. The 12 foot land -transfer will have to be presented <br /> for Commission consideration, he added. <br /> Because there had been. some indication that the Equinox owners might <br /> be considering a request that the planted area across from Silver <br /> • Lane be developed for single family dwellings , Mr. Jones had requested <br /> staff to research the minutes of the meetings where the Equinox <br /> apartments were first allowed and copies of three 1969 Commission - <br />
