Planning Commission Regular Meeting Minutes <br /> August 16, 1994 <br /> Page 13 <br /> 1 Discussion ensued regarding conflicts that arise when a six foot back yard fence abuts an <br /> 2 interior side yard in front of the primary structure where only a four foot fence is allowed. <br /> 3 Discussion was also held regarding property that abuts a public alley. <br /> 4 Commissioner Makowske suggested that a six foot fence be allowed in back yards that <br /> 5 abut an alley. <br /> 6 With regard to the language proposed by staff-and more detailed language proposed by <br /> 7 Commissioner Makowske, City Manager Mornson stated his preference to keep the <br /> 8 language simple and open for interpretation. He explained that making an ordinance <br /> 9 amendment requires a public hearing; however, only a motion is needed if it is handled <br /> 10 through a policy. <br /> 11 Commissioner Franzese expressed concern that the language may be too vague and <br /> 12 difficult for residents to interpret. She also suggested that the word "may" be revised to <br /> 13 "shall". <br /> 04 The Commission agreed to consider language as suggested by staff, changing "may" to <br /> 15 "shall" and adding a section to 1320.03, Sub. 3 to state "On an interior side yard where it <br /> 16 abuts a back yard on a corner lot, a six foot fence is permitted." <br /> 17 Consensus was reached to direct staff to schedule a public hearing on an zoning <br /> 18 ordinance amendment relating to corner lot fences at the September 20, 1994 meeting. <br /> 19 VIII. MISCELLANEOUS. <br /> 20 A. List of needed information from applicants for Planning Commission items. <br /> 21 In his staff report, City Manager Morrison reviewed staffs recommendation on the items <br /> 22 that applicants need to submit prior to the Tuesday meeting of the Planning Commission <br /> 23 or City Council meeting. <br /> 24 Commissioner Faust asked if staff enforces a cut off date for applications or revisions. <br /> 25 City Manager Mornson explained they allow until ten days prior to the public hearing so <br /> 26 notice can be published. Commissioner Faust spoke in support of establishing and <br /> 27 maintaining a deadline to avoid preferential treatment. <br /> Consensus was reached to approve the submittal requirements as recommended by staff. <br />
