Block 1, Silver Lake Center(Apache Plaza) (96- <br /> 3 16 <br /> 4 1. Conditional Use Permit- Video Sales and Rental. <br /> 5 2. Sign Variance Request-Video Sales and Rental; Bagel Shop. <br /> 6 Chair Bergstrom opened the public hearing at 7:10 P.M. <br /> 7 Ms. Kim Moore-Sykes, Management Assistant reported Lee Stedman of Realty Development <br /> 8 Advisors, LLC, has applied for a conditional use permit for a proposed video rental store that is <br /> 9 one of two proposed stores to be built as part of the Apache Plaza redevelopment plan for Lot 3. <br /> 10 The second store, a bagel shop, is an allowed use in the commercial zoning district. <br /> 11 The proposed video rental store is a use that is allowed in a commercial zoning district such as <br /> 12 Apache Plaza(Chap. 16, Section 1635.03, (I)). The use will not be detrimental to health, safety, <br /> 13 or general welfare of the people living or working in the vicinity. As stated by their conditional <br /> 14 use application,the proposed store will not contain X-rated video tapes. The Apache Plaza <br /> 15 location is desirable for the proposed use because it is a convenient location for the community. <br /> 16 This proposed use will not be detrimental to property values, but instead, it is expected to <br /> 17 increase the redevelopment value of the surrounding commercial properties and the area as a <br /> whole. <br /> 19 Ms. Moore-Sykes reported Lee Stedman has also requested a sign variance for the building that <br /> 20 is housing the video and bagel stores. As the site plan shows, the proposed building is situated <br /> 21 such that it has business frontage on the east and south sides. Mr. Stedman is requesting a sign <br /> 22 variance for the north side of the building, which has no business right-of-way frontage, to take <br /> 23 advantage of the southbound vehicular traffic on Silver Lake Road. <br /> 24 The proposal is to have two wall signs, one on the east side of the building that will wrap around <br /> 25 to the south side and does not require a variance. The other sign is proposed to be on the east <br /> 26 side of the building-and will wrap around to the north side. These wrap around wall signs will <br /> 27 not exceed 15% of the area of the wall to which the sign will be applied. <br /> 28 Staff is recommending the approval of the conditional use permit being requested by Lee <br /> 29 Stedman of Realty Development Advisors, LLC based on the fact that the City Ordinance allows <br /> 30 the use as a conditional use in a commercial zoning district. <br /> 31 Staff is also recommending the approval of the sign variance request for business right-of-way <br /> 32 frontage on the north side of the proposed building to accommodate the need for increased <br /> 33 visibility for traffic going southbound on Silver Lake Road and traffic in the retail center. <br /> The conditions upon which this variance request is based are unique to this area because Apache <br /> Plaza is being redeveloped into a retail center that has independent retail businesses being <br /> 36 planned along Silver Lake Road and are not part of the main retail center.
