Giesther, et al <br /> 3242 Highway 8 <br /> Minneapolis , MN 55418 <br /> Dear Sirs , <br /> Your property, located at 33rd Avenue N.E. and Old Highway 8, <br /> • has been zoned for single family residential (R-1) use for many <br /> years . <br /> The original use of the property was for excavating and con- <br /> tracting work and has existed as a legal , non-conforming use during <br /> that time . In recent months , however, it has . been noted that the <br /> excavating/contracting use of the , property has become subordinate <br /> to a growing new land use - that of a trucking business . We have <br /> noted many .large over-the-road semi-trailer vehicles on .the property <br /> and have received numerous complaints from neighbor residents con- <br /> cerning refrigerator units operating all night. <br /> It is our position that the current use of the property for <br /> a trucking operation is in violation of the zoning ordinance and <br /> you are hereby ordered to cease all trucking operations from said <br /> property within 15 days of receipt of this letter. <br /> I have enclosed a copy of the section of the zoning ordinance <br /> dealing with non-conforming uses , and it is clear that the trucking <br /> operation is not part of the above provisions , and any activities <br /> other than the original use of the property must cease. <br /> Sincerely, <br /> • David M.
