Planning Commission Meeting <br /> February 20, 1990 <br /> page 5 <br /> 1 supervision of the Minnesota Pollution Control Agency. He stated that if <br /> 2 no leakage is detected the tanks can remain in place. If leakage is noted <br /> 3 numerous tests must be conducted. The City Manager mentioned there was <br /> 4 legislation passed in 1989 regarding the monitoring of storage tanks. He <br /> 5 will follow up on this and find out the date when monitoring must commence. <br /> 6 <br /> 7 Orville Hauge, 3300 Roosevelt Court, inquired why the property can 't be <br /> 8 used as it is presently zoned. Chairperson Madden responded that Mr. <br /> 9 Fisher was unable to market the residences he had proposed building. Mr <br /> 10 Hauge also inquired what the allowable maximum signage would be on a <br /> 11 building on this property. The City Manager advised that Mr. Fisher has <br /> 12 only requested a rezoning and has not made application for anything else: <br /> 13 <br /> 14 Commissioner Franzese observed that no one on the Planning Commission knows <br /> 15 what Mr. Fisher is planning for the property, a situation she finds <br /> 16 embarrassing., <br /> 17 <br /> 18 VanderHeyden told the Commission that if this item is on the March 20th <br /> 19 Planning Commission Meeting agenda, she will have notices sent to all <br /> 20 of the affected property owners -again. <br /> 21 <br /> 22 Chairperson Madded requested the City Manager to research what would be <br /> 23 a permitted size of a building-on Mr. Fisher' s property. He also inquired <br /> 24 if the Planning Commission could apply restrictions on its recommendation <br /> 25 to the City Council ; such as tearing down the building that presently <br /> 26 is on the property. The City Manager stated that conditions are restricted <br /> 27 on a zoning request. He noted that if the present building isn't changed <br /> 28 and used as it stands, the City would be hard put to require removal of <br /> �9 the underground storage tanks. If there is any modification of the site <br /> 30 the owner would be required to remove the tanks. <br /> 31 <br /> 32 Commissioner Franzese inquired if the residents found it disruptive when <br /> 33 a gas station operated at this location. Mrs. Hauge stated it was dis- <br /> 34 ruptive with cars parking there after the station closed. <br /> 35 <br /> 36 Discussion continued regarding who owns a forty foot lot adjacent to this <br /> 37 property. VanderHeyden noted that it is not owned by Mr. Fisher. The City <br /> 38 Manager will confirm ownership with the County Assessor. <br /> 39 <br /> 40 Chairperson Madden again apologized for Mr. Fisher' s absence and thanked <br /> 41 the residents who did attend.. <br /> 42 <br /> 43 One letter was. receved from Laurel Frederickson, 3323 - 25 Stinson Boulevard, <br /> 44 in opposition to the rezoning. <br /> 45 <br /> 46 The Public Hearing was continued. <br /> 47 <br /> 48 6.
