APACHE PLAZA, LTD. <br /> STORMWATER SYSTEM MAINTENANCE AGREEMENT <br /> APACHE PLAZA <br /> AGREEMENT <br /> TIIIS AGREEMENT is dated as of the day of in the year 1994 <br /> by and between Apache Plaza, Ltd. (hereinafter called "Apache") and the City of St. Anthony <br /> (hereinafter called "City"). <br /> Apache and City, in consideration of the mutual covenants hereinafter set forth; agree to the <br /> following terms of the Stormwater System Maintenance Agreement: <br /> Procedures for Sweeping <br /> Apache shall perform vacuum sweeping of the Apache Plaza driveways and parking lots three <br /> times per year. The actual vacuum sweeping will be done-by a subcontractor and the debris <br /> removed by the equipment will be disposed of by the subcontractor. Apache will include, along <br /> with their regular notification to the City, records of the vacuum sweeping indicating dates of <br /> sweeping and areas swept. <br /> Pond and Parking Lot Inspection Schedule and Criteria for Inspection <br /> The three detention ponds shall be inspected on an annual basis to determine wet detention <br /> volume. When the survey of any pond reveals that the wet detention volume has dropped below <br /> 50 percent of the original designed wet detention volume, Apache will retain a subcontractor to <br /> remove sediment from the pond. <br />
