We have also created a concept comprehensive <br /> drainage plan that would be sufficient for any future <br /> redevelopment of the remaining mall property. This <br /> information has been submitted as part of our EAW. <br /> Any future redevelopment of the remaining mall will <br /> also fully comply with all then-current Rice Creek <br /> Watershed District guidelines. <br /> Pond Maintenance <br /> As is a common practice with most cities today, we <br /> would propose that the 'City . of St. Anthony acquire fee <br /> title to the outlots and that the City of St. Anthony <br /> accept the responsibility of the maintenance of these <br /> ponds. This will insure that proper control measures <br /> and maintenance of the ponds will be enforced by one <br /> governing body which is an especially important <br /> concept, considering there will likely be multiple <br /> owners and properties utilizing these ponds. <br /> Reimbursement for all maintenance costs, including a <br /> reasonable management fee, will be paid by each of <br /> the property owners utilizing the ponds directly to the <br /> City. These costs should be prorated based upon land <br /> size. A Pond Maintenance Agreement will be signed <br /> by all current and future property owners as a <br /> requirement to any City approvals and/or prior to any <br /> transfer in fee title. The Agreement's format will be <br /> consistent in its terms and conditions between all <br /> parties. <br /> Easements <br /> As part of the redevelopment plan, there will need to <br /> be put in place various easements to allow each of the <br /> lots to function together efficiently as one larger <br /> shopping center development. With the use of drive- <br /> lane and parking easements, where necessary, each lot <br /> will have sufficient ingress and egress to the main <br /> drive-lanes accessing the shopping center, as well as <br /> sufficient parking available. These easements will be <br /> identified and detailed in a restricted covenant <br /> agreement between all lot owners. <br />
