Marie Company <br /> Apache Plaza <br /> Vacation of Easements <br /> Please consider this the application of our ,client, Ste. Marie <br /> Company, to vacate those certain easements in favor of the Village <br /> of St . Anthony described in a Quit Claim Deed dated February 11, <br /> 1963, recorded in the office of the Ramsey County Recorder as <br /> Document No. 1584191 . A photocopy of the original recorded Quit <br /> Claim Deed is enclosed. The legal descriptions of the easements <br /> are set forth in the Deed. I also enclose a site plan showing the <br /> location of these easements . <br /> In addition, we also request the termination/vacation of that <br /> certain Declaration of Restrictions dated December 29, 1994, in <br /> favor of the City of St . Anthony, recorded as Document No. 2847959, <br /> relating to the prior platting by Apache Plaza Ltd. I enclose a <br /> photocopy of the recorded Declaration. I am not sure whether the <br /> procedure for terminating/vacating this document and the rights <br /> thereunder are the same as for the vacation of public easements. <br /> Nevertheless, to be on the safe side, we request this be treated in <br /> the same manner as an easement vacation. Of course, if you and <br /> Bill Soth decide a hearing is not necessary under the City code and <br /> ordinances, perhaps it can be handled by a simple City Council <br /> resolution. <br /> Please make such postings and publications and give such <br /> notices as are required under the City' s ordinances to accomplish <br /> these vacations and/or terminations . We would like this matter to <br /> be resolved as soon as possible, but in any event no later than <br /> final plat approval for the new Silver Lake Center plat . <br />
