121 —20th Avenue S.W. <br /> New Brighton,MN 55112 <br /> March 12, 1999 <br /> Members of the Planning Commission and City Council <br /> St. Anthony Village <br /> 3301 Silver Lake Road <br /> St. Anthony, Minnesota 55418 <br /> Dear Members: <br /> We are pleased to submit the attached Petition for Variance, the granting of which will <br /> permit us to build a single family home on a vacant lot, the PIN # of which is 31-30-23- <br /> 42-0167-8,with a probable address of 4004 Fordham Drive,N.E., St. Anthony, MN. <br /> Our need to apply for a variance arises from the fact that the lot is smaller than required <br /> by the current St. Anthony Zoning Code. The lot measures 60 feet wide.by 133.085 feet <br /> in average depth, leaving it 15 feet less in width (75-60) and 1,015 sq. feet less in square <br /> footage (9000-7985). There is no available adjoining land to add to it. There are several <br /> other lots in the vicinity which are substandard, either because they existed before the <br /> current Zoning Code went into effect or because variances have been granted under the <br /> provision of the current Zoning Code. <br /> We believe this Petition is consistent with the conditions St. Anthony Village has spelled <br /> out for granting a variance (1665.06, Variances), namely by presenting the following <br /> factual evidence (Subd.3. Evidence): <br /> (a) The subject matter of the application is within the scope of this <br /> Subsection. <br /> (b) Strict enforcement would cause undue hardship because: <br /> (1) The property cannot be put to a reasonable use without the variance. <br /> (2) The' circumstances causing the hardship were not created by the <br /> owner. <br /> (3) The variance, if granted, will not alter the essential character of the <br /> locality. <br /> (4) Economic considerations alone are not the basis of the hardship. <br /> (c) The circumstances causing the hardship are unique to the individual <br /> property under consideration. <br /> (d) The granting of the variance is in keeping with the spirit and intent of the <br /> Zoning Code. <br /> We believe that the variances we are requesting conform to these facts. <br />
