Planning Commission Meeting Minutes <br /> June 18, 2002 <br /> Page 7 <br /> 1 Vice Chair Stille stated that he had a difficult time finding hardship in the parking <br /> 2 variance request. <br /> 3 <br /> 4 Commissioner Steeves stated that this Ordinance should be moved forward so that the <br /> 5 package would be ready to go. <br /> 6 <br /> 7 Commissioner Thomas stated that he agreed with Commissioner Steeves that they should <br /> 8 move forward with the Ordinance and change the code at a later date. <br /> 9 <br /> 10 Motion by Commissioner Steeves, second by Commissioner Thomas, that given the <br /> 11 constraints of the site and the owners requirements placed upon the applicant by the <br /> 12 City's parking Ordinance, the Planning Commission believes this creates undo hardship <br /> 13 for the applicant and that they would grant a variance as outlined in Staff s report. <br /> 14 <br /> 15 Motion carried unanimously. <br /> 16 <br /> 17 Chair Melsha asked City Staff if the City Attorney and City Engineer would review the <br /> 18 re-plat plan. <br /> 19 <br /> 20 Motion by Chair Melsha, second by Commissioner Hoska, to recommend approval to <br /> 21 combine Lot 1, Block 1, Apache Plaza with Lot 2, Block 1, Apache Plaza, subject to the <br /> 22 following conditions: <br /> 23 • Approval of the City Attorney and City Engineer. <br /> 24 • Proof of title by the applicants for both lots. <br /> 25 <br /> 26 Motion carried unanimously. <br /> 27 <br /> 28 Commissioner Hanson stated that the City has created the request for variance in many <br /> 29 ways because they have asked the applicants to expand their store from their original <br /> 30 thought. <br /> 31 <br /> 32 Motion by Commissioner Steeves, second by Commissioner Hanson, that given the <br /> 33 ingress/egress requirements of this site as well as the desire if the City to have a larger <br /> 34 facility on this site, to grant a variance of a rear-yard setback of 4.25 feet to meet the 20 <br /> 35 feet setback requirement. <br /> 36 <br /> 37 Motion carried unanimously. <br /> 38 <br /> 39 2.1 City of St. Anthony, Amend City Ordinance relating to the definition of"garage" <br /> 40 and "accessory building" and to regulate the size of garages in residential districts. <br /> 41 Chair Melsha opened the public hearing at 9:00 p.m. <br /> 42 <br /> 43 Hall stated that this amendment has to do with the floor area ratio and how it is figured. <br /> 44 She stated that the issue arose this spring in the plans for a new single family home at <br /> 45 3501 Downers Drive. The builder, Tom Brama, did not agree with how the floor area <br /> 46 ratio was figured and had a different interpretation of the code than the Building Official. <br /> 47 Brama did not believe that the garage should be treated as part of the floor area of the <br /> 48 home. <br />
