Mr. Stoick <br /> 3 confirmed. <br /> 4 <br /> 5 Chair Stromgren closed the public hearing at 7:12 p.m. <br /> 6 <br /> 7 Motion by Commissioner Tillman, seconded by Vice Chair Hanson, to recommend approval of <br /> 8 the subdivision and preliminary plat of the property located at 2917 Anthony Lane North subject <br /> 9 to the recommendations made by the City Engineer. <br /> 10 <br /> 11 Motion carried unanimously <br /> 12 <br /> 13 Chair Stromgren stated that City Council would consider this request at their October 26, 2004 <br /> 14 Regular meeting. He suggested that the applicants be present to answer any questions the <br /> 15 Council might have. <br /> 16 <br /> 17 7.2 Sunset Memorial Park, 2250 St. Anthony Boulevard Rezone Property from R-1 Single <br /> 18 Family Residential to Recreational Open Space ROSS <br /> 19 <br /> 20 Chair Stromgren opened the public hearing at 7:14 p.m. <br /> 21 <br /> Ms. Hall stated that this is a Public Hearing for a rezone request for the Sunset Memorial Park <br /> cemetery located at 2250 St. Anthony Boulevard. She explained that the applicant is requesting <br /> 24 to rezone the property from R-1 Single Family Residential to Recreational Open Space(ROS). <br /> 25 She stated that the Planning Commission's recommendation would be forwarded to City Council <br /> 26 for consideration at their October 26, 2004 meeting. She stated that currently the property is R-1 <br /> 27 Single Family Residential noting that the current.zoning classification is considered legal non- <br /> 28 conforming. She explained that the applicant and owner of the cemetery site, Alderwoods <br /> 29 Group, would like to rectify and are requesting a rezone to ROS to conform to the City <br /> 30 Ordinance. She provided the Commission with a brief overview stating that the ROS zoning <br /> 31 district allows cemeteries as a permitted use and also allows mausoleums and crypt structures as <br /> 32 permitted accessory structures. She noted that Sunset Memorial Park has a mausoleum onsite. <br /> 33 She stated that at the September 21, 2004 Planning Commission meeting Mekus Studios <br /> 34 presented plans to demolish the existing administration building on St. Anthony Boulevard and <br /> 35 build a new funeral home on the site. She indicated that at this time, the applicant has informed <br /> 36 the City that they are studying the funeral home issue further and would only like to discuss the <br /> 37 rezone issue. <br /> 38 <br /> 39 Ms. Hall stated that if the applicant were to pursue the funeral home concept on the site in the <br /> 40 future that other City approvals would be necessary. She stated that the City has made this clear <br /> 41 to the applicant on several occasions and reviewed with the Commission. She explained that <br /> 42 following the change in zoning classification from R-1 to ROS, the applicant would need to <br /> 43 request a text amendment to the ROS district to allow funeral homes as a permitted conditional <br /> use. She further explained that a public hearing at the Planning Commission and three readings <br /> 4� by the City Council would be necessary for approval of the text amendment. She stated that if <br /> 46 the City approves this, the applicant would have to apply for a conditional use permit and go <br />
