Mr. Stoick 3 confirmed. 4 5 Chair Stromgren closed the public hearing at 7:12 p.m. 6 7 Motion by Commissioner Tillman, seconded by Vice Chair Hanson, to recommend approval of 8 the subdivision and preliminary plat of the property located at 2917 Anthony Lane North subject 9 to the recommendations made by the City Engineer. 10 11 Motion carried unanimously 12 13 Chair Stromgren stated that City Council would consider this request at their October 26, 2004 14 Regular meeting. He suggested that the applicants be present to answer any questions the 15 Council might have. 16 17 7.2 Sunset Memorial Park, 2250 St. Anthony Boulevard Rezone Property from R-1 Single 18 Family Residential to Recreational Open Space ROSS 19 20 Chair Stromgren opened the public hearing at 7:14 p.m. 21 Ms. Hall stated that this is a Public Hearing for a rezone request for the Sunset Memorial Park cemetery located at 2250 St. Anthony Boulevard. She explained that the applicant is requesting 24 to rezone the property from R-1 Single Family Residential to Recreational Open Space(ROS). 25 She stated that the Planning Commission's recommendation would be forwarded to City Council 26 for consideration at their October 26, 2004 meeting. She stated that currently the property is R-1 27 Single Family Residential noting that the current.zoning classification is considered legal non- 28 conforming. She explained that the applicant and owner of the cemetery site, Alderwoods 29 Group, would like to rectify and are requesting a rezone to ROS to conform to the City 30 Ordinance. She provided the Commission with a brief overview stating that the ROS zoning 31 district allows cemeteries as a permitted use and also allows mausoleums and crypt structures as 32 permitted accessory structures. She noted that Sunset Memorial Park has a mausoleum onsite. 33 She stated that at the September 21, 2004 Planning Commission meeting Mekus Studios 34 presented plans to demolish the existing administration building on St. Anthony Boulevard and 35 build a new funeral home on the site. She indicated that at this time, the applicant has informed 36 the City that they are studying the funeral home issue further and would only like to discuss the 37 rezone issue. 38 39 Ms. Hall stated that if the applicant were to pursue the funeral home concept on the site in the 40 future that other City approvals would be necessary. She stated that the City has made this clear 41 to the applicant on several occasions and reviewed with the Commission. She explained that 42 following the change in zoning classification from R-1 to ROS, the applicant would need to 43 request a text amendment to the ROS district to allow funeral homes as a permitted conditional use. She further explained that a public hearing at the Planning Commission and three readings 4� by the City Council would be necessary for approval of the text amendment.
