Planning Commission Meeting Minutes <br /> October 19, 2004 <br /> Page 6 <br /> Commissioner Tillman noted that right now funeral homes are not part of the ROS and reviewed <br /> 2 with the Commission. She asked if the applicant's course of action, to bring the property into <br /> 3 conformity, would still be the same if they knew that the rezone would not come to be. Mr. <br /> 4 Tyson confirmed stating that this is what they are seeking to do now. <br /> 5 <br /> 6 Commissioner Gray asked what is in it for the Alderwoods Group if the change is approved. He <br /> 7 stated that this request for a rezone change seems a bit strange noting that the applicant could do <br /> 8 the building right now as it is currently zoned and asked why the rezoning a big deal. Mr. Tyson <br /> 9 explained that the Sunset Funeral Home and Cemetery is here to be a part.of the St. Anthony <br /> 10 community, as it has been for many years. He further explained that to be a part of this <br /> 11 community means that they should be able to be responsive to their needs as they grow and to <br /> 12 also be responsive to the Community with respect to their concerns for the history of the <br /> 13 structures. He stated that the applicant is currently seeking to determine what they have to work <br /> 14 with and now find themselves in situation where they are not conforming to the existing zoning, <br /> 15 and would be inconsistent with the overall plan of the City. He stated that his client is trying to <br /> 16 bring the property into conformity one step at a time. <br /> 17 <br /> 18 Commissioner Young acknowledged that they are only discussing the rezoning. She stated that <br /> 19 currently mausoleums and crypts are allowable use in the R1 and if rezoned to ROS they would <br /> 20 also be discussing a chapel and an administrative building that would have to be considered as <br /> 21 conditional use. She asked how do they define a cemetery, as just green space or does it also <br /> include any.structures located on the property. She asked if they would run into any problems <br /> with the funeral home already listed as a commercial use and if there are any tax assumptions <br /> 24 that could be impacted. Ms. Hall explained that the Planning Commission does not deal with tax <br /> 25 issues here adding that their concern is policy and recommending zoning. <br /> 26 <br /> 27 Chair Stromgren noted that the four maintenance buildings are also covered under the ROS <br /> 28 district. <br /> 29 <br /> 30 Commissioner Tillman clarified that if the Commission is not ready to make a decision that they <br /> 31 could request an extension. She stated that she would like further explanation from the City <br /> 32 Attorney regarding potential impacts and control noting that she is not clear on what they are <br /> 33 making their decision on. <br /> 34 <br /> 35 Commissioner Gray stated that if they are addressing the issue of consistency they should also <br /> 36 rezone the other cemetery at same time. He agreed that the Commission should fully understand <br /> 37 the ramifications of rezoning. Chair Stromgren agreed that the rezoning and surrounding issues <br /> 38 should be considered in a broader context than just Sunset Memorial. <br /> 39 <br /> 40 Commissioner Jensen stated that he is not comfortable with making a decision at this time noting <br /> 41 that there is still a large amount of research that needs to be done. <br /> 42 <br /> 43 Chair Stromgren clarified that the extension would be adopted by City Council and would reflect <br /> a 60-day extension. Ms. Hall confirmed that they could recommend a 60-day extension and that <br /> 4-) City Council would approve the extension. <br /> 46 <br />
