/ 1 <br /> -2- <br /> r. Irving Walbon presented a plan for the remodeling of his building at <br /> ZM32 <br /> 42 Highway #8. Mayor O'Connor invited those neighbors present to examine <br /> the plan. Mr. Irving Walbon explained in detail his proposed development <br /> of the area around the building and how he proposed to remodel the existing <br /> building. Mr. Bowerman, 3129 Croft Drive presented a petition to the Council <br /> protesting the favorable recommendation of the Planning Board for the remodel- <br /> ing of the Walbon building. Mr. Bowerman asked if a hearing was to be held <br /> on the proposal and stated that if a hearing was to be given the adjacent <br /> property owners, he would withdraw the petition. Mr. Haik, Village Attorney <br /> stated that the owner was allowed to maintain the structure. He felt the <br /> changing of doors etc. would constitute an enlargement, but that it was a fact <br /> question that would have to be determined by a court. Mr. Olson, Village <br /> engineer, stated that he had staked the area that was described as non-conform <br /> ing use and that the area did not include the approximate westerly twenty five <br /> feet as shown in the proposal. The Village Manager was directed to compare the <br /> described area of record with the proposal and report the findings to the <br /> Council at the next meeting. Mr. Howita stated that he felt that the owners <br /> were making an honest effort to improve the property. Mayor O'Connor stated <br /> that the owners of adjacent property were to be notified of any changes in the <br /> Walbon property. Mr. Levander, attorney, stated that he felt the owner was <br /> not attempting to develop the property beyond the described limits on file. <br /> Councilman Bailey and Councilman Sorenson expressed the opinion that the remod- <br /> eling of the building would improve the looks of the area. Councilman Dougherty <br /> felt the proposed work would be an improvement but that the area included in <br /> . the proposal should not exceed the nonconforming use area as designeted. He <br /> felt the area not included should be closed off and sodded with proper plant- <br /> ings to provide screening from adjoining property. Councilman Bailey asked <br /> Mr. Walbon if he would be willing to place a barrier separating the two areas <br /> and Mr. Walbon replied that he would be willing. Councilman Springer suggested <br /> that an information meeting be held that would not be part of a Council session. <br /> He stated that if a vote were taken he would approve the proposal at this time. <br /> Councilman Sorenson moved and seconded by Councilman Dougherty that the <br /> Planning Board be directed to hold an informal meeting in order to give the <br /> neighbors an opportunity to be heard and that the Council consider the matter <br /> at its next regular meeting on August 23, 1966. <br /> Motion Carried. <br /> Afer considerable discussion, Councilman Springer moved and seconded by <br /> Councilman Dougherty that the request of Empire Sales Company Incorporated <br /> to increase their proposal to build a 36 unit apartment at 3817 Macalaster <br /> Drive by six (6) units be approved subject to conformation to the building <br /> Ordinance as to number of units allowable on a given area and also subject to a <br /> 20' easement for future storm sewer construction that would be located in an <br /> easterly direction along the Soo Line R.R. R/W from a point of intersection <br /> with the drainage line under the R/W of the Soo Line R.R. that bisects the <br /> proposed parking area, and also that the property owner maintains the area to <br /> be combined with lots 3,4 and identified as the S11 of lotl , Block 10, Mounds <br /> View Acres, 2nd Addition. <br /> Motion Carried. <br /> .�-Wes Robertson presented a plan for a 13 unit garage addition to Highcrest <br /> Manor Apartments. The units to be located 30' north of the present garage <br /> units along 37th Avenue N.E. After discussion, Councilman Dougherty moved <br /> and seconded by Mayor O'Connor that the proposed 13 unit garage addition to <br /> Highcrest Manor Apartments be approved. <br />
