VILLAGE OF ST. ANTHONY <br /> COUNCIL MINUTES <br /> October 7, 1969 <br /> The meeting was called to order by the Mayor at 8:00 o'clock P.M. <br /> The following were present at roll call : O'Connor, Emond, Dougherty <br /> Also present: Raymond Haik, Village Attorney <br /> Ice Comstock, Village Engineer <br /> John Printon, Village Manager <br /> The Mayor declared the Public Hearing on improvements to be levied in 1970 to <br /> be open. <br /> Improvement 1968-3 costs were explained, and there being no questions, this <br /> portion of the hearing was closed. <br /> Councilman Levandowski joined the meeting at 8:10 P.M. <br /> Street Improvement 1968-4 was discussed. A written objection was received from <br /> Richard Fudali regarding an assessment placed against Lake Hill Apartments on <br /> Highcrest Road North of 37th Avenue N.E. The objection was discussed and the <br /> council took no action to change the assessment against the aforementioned <br /> property. There being no further objection this portion of the hearing was <br /> • closed. <br /> Chandler Drive and Foss Road were next considered. Mr. R. E. McGary representing <br /> Mrs. Hinkel, property owner presented an oral objection to the assessment <br /> against Lots 1 & 2, Block 11, Mounds View Acres, 2nd. Addition. He stated that <br /> his client was charged for frontage on both streets and that the assessment <br /> should be on a full frontage on Foss Road and a 1/3 assessment on Chandler Drive. <br /> The Councils policy was explained by the Mayor, that all property abutting a <br /> street improvement is considered to receive equal benefit and is assessed on a <br /> front foot basis. <br /> Mr. Mike Carrol stated that he would object to the assessment if proper access is <br /> not afforded him to his driveway. The Council assured Mr. Carrol that the <br /> Village would install an asphalt access from Foss Road to his driveway entrance. <br /> The Chandler Drive and Foss Road portion of the hearing was closed. <br /> Mr. Don Gmarhart, 4016 Shamrock Drive presented an objection to the width of <br /> lot shown on the assessment roll as being 1121. He was informed that the section <br /> maps would be re-checked to verify his claim of 110' width and the assessment <br /> corrected if found to be in error. <br /> Mr. Kylander, Silver Lane, asked who would pay for errors if section of concrete <br /> were taken up and replaced. He was informed that the section under discussion <br /> would be corrected by the contractor at no charge to the property owners. <br /> Mr. Don Gearhart stated that he was discriminated against in the paving of <br /> driveway approaches. After discussing the matter, the Council agreed to include <br /> one-half of the 26' driveway area in the project. <br />
