VILLAGE OF ST. ANTHONY COUNCIL MINUTES October 7, 1969 The meeting was called to order by the Mayor at 8:00 o'clock P.M. The following were present at roll call : O'Connor, Emond, Dougherty Also present: Raymond Haik, Village Attorney Ice Comstock, Village Engineer John Printon, Village Manager The Mayor declared the Public Hearing on improvements to be levied in 1970 to be open. Improvement 1968-3 costs were explained, and there being no questions, this portion of the hearing was closed. Councilman Levandowski joined the meeting at 8:10 P.M. Street Improvement 1968-4 was discussed. A written objection was received from Richard Fudali regarding an assessment placed against Lake Hill Apartments on Highcrest Road North of 37th Avenue N.E. The objection was discussed and the council took no action to change the assessment against the aforementioned property. There being no further objection this portion of the hearing was • closed. Chandler Drive and Foss Road were next considered. Mr. R. E. McGary representing Mrs. Hinkel, property owner presented an oral objection to the assessment against Lots 1 & 2, Block 11, Mounds View Acres, 2nd. Addition. He stated that his client was charged for frontage on both streets and that the assessment should be on a full frontage on Foss Road and a 1/3 assessment on Chandler Drive. The Councils policy was explained by the Mayor, that all property abutting a street improvement is considered to receive equal benefit and is assessed on a front foot basis. Mr. Mike Carrol stated that he would object to the assessment if proper access is not afforded him to his driveway. The Council assured Mr. Carrol that the Village would install an asphalt access from Foss Road to his driveway entrance. The Chandler Drive and Foss Road portion of the hearing was closed. Mr. Don Gmarhart, 4016 Shamrock Drive presented an objection to the width of lot shown on the assessment roll as being 1121. He was informed that the section maps would be re-checked to verify his claim of 110' width and the assessment corrected if found to be in error. Mr. Kylander, Silver Lane, asked who would pay for errors if section of concrete were taken up and replaced. He was informed that the section under discussion would be corrected by the contractor at no charge to the property owners. Mr. Don Gearhart stated that he was discriminated against in the paving of driveway approaches. After discussing the matter, the Council agreed to include one-half of the 26' driveway area in the project.
