• --2- <br /> Michael Carroll, 3829 Foss Road, requested the Council to authorize regrading and <br /> relocation of his driveway due to the hazard of a steep bank adjacent to this <br /> driveway as a result of the City relocating 39th Avenue N.F. to its proper right- <br /> of-way. <br /> ight- <br /> of-way. <br /> Jim Shaughnessy, Mr. Carroll's brother-in--law, felt that the City had an obligat- <br /> ion to maintain the boulevard adjacent to 39th Avenue N.E. in a safe manner. <br /> The City Manager felt that the City should not do any work on the property because <br /> no work is done on other residents property and that the City may be liable should <br /> the work be insufficiently or improperly done and a car slips off the bank on <br /> 39th Avenue N.F. <br /> Motion by Councilman Stauffer, seconded by Councilman Haik to provide posts for <br /> Mr. Carroll to place in the ground next to his driveway and to seed and sod the <br /> bank on 39th to control the erosion problem. Mr. Carroll is to have no further <br /> recourse to the city. <br /> Voting on the motion: <br /> Aye: Haik, Sauer, Sundland, Stauffer <br /> Nay: Mied tke <br /> • Motion carried. <br /> George Wynn reported on plans for the Village Celebration and requested all <br /> necessary licenses and permits. <br /> Motion by Councilman Sundland, seconded by Councilman Haik to waive all fees and <br /> grant the necessary licenses and permits for the St. Anthony Celebration to be <br /> held Sunday, September 15, 1974. <br /> Motion carried. <br /> Mayor Miedtke ordered a recess at 8:40 P.M. The meeting reconvened at 8:48 P.M. <br /> The City Manager reported on Hennepin County's Revocation of CSAH 27. He was of <br /> the opinion that we should not accept the revocation until an overlay and <br /> necessary repairs are made to the street. <br /> Motion by Councilman Sundland, seconded by Councilman Haik to table discussion <br /> with Hennepin County on the revocation of CSAH 27 until all necessary repairs <br /> are made. <br /> Motion carried. <br /> Motion by Councilman Sauer, seconded by Councilman Sundland to write off <br /> $1,684.17 in checks as uncollectible from the liquor operation. <br /> • Motion carried. <br /> Henry Zeug was appointed by Councilman Haik to the Human Relations Board. <br /> Councilman Stauffer solicited council members metropolitan concerns for the <br /> Metropolitan Significance Committee. <br />
