The Mayor indicated to those present <br /> that the proceedings of that evening did not involve a public hearing but that <br /> he would open the meeting to a 15 minute discussion on the request by members <br /> of the Planning Board, Council members and residents of the area neighboring the <br /> Hedlund property who were present. <br /> The City Manager advised that the request for a Country Kitchen would require <br /> a rezoning to a Commercial use rather than a conditional use permit and it <br /> appeared that a new platting of the tract would have to be approved to allow <br /> a lot split to accomodate the restaurant. <br /> Comments from the residents were all unfavorable to the proposal and included <br /> their objections to commercial use of the land. <br /> Councilman Sundland felt a C-2 use of the land was too intensive a transitional <br /> from residential. <br /> Councilman Haik expressed her objections to giving any consideration to changing <br /> the zoning until the new City zoning ordinance had been passed and said she <br /> felt there should be the same objections to Mr. Hedlund's proposal as those <br /> which had resulted in the Council's refusal to .grant a change of zoning to the <br /> owners of lots at the corner of Silver Lake Road and 37th Avenue N.E. She also <br /> said she felt the Council should be consistent in its determinations. <br /> Councilman Stauffer told of the difficulty she had in accepting the 80 foot <br /> lots when they were part of the agreement reached to grant a conditional use <br /> permit to Rembrandt for a retirement complex and was opposed to a C-2 usage <br /> adjacent to a residential development. <br /> Councilman Sauer wondered if Mr. Hedlund wanted to undertake the expense of <br /> filing fees, etc. necessary to requesting a public hearing on his proposal in <br /> view of the opposition expressed that evening and asked the City Attorney if the <br /> Council could refuse the request for a public hearing. <br /> Mr. Vickrey replied that the Council would probably not want to refuse a request <br /> for a public hearing for rezoning the property for a specific use such as the <br /> Country Kitchen but was not required to hold a hearing on a request for a <br /> conditional use permit for a non-specific proposal for office buildings. <br /> When the Manager pointed out that the Council did not even have the exact <br /> location for the Country Kitchen nor a request for a specific use for the rest <br /> of the tract the following motion was made: <br /> Motion by Councilman Stauffer and seconded by Councilman Haik to table action <br /> on the request from Mr. Gordon Hedlund for a public hearing until such a time <br /> when a proper and complete application is made and the necessary administration <br /> procedures are followed. <br /> Motion carried. <br /> Mrs. Carol Brown presented the revised parking and landscaping plans for the <br /> . Herfurth Real Estate Office at 3901 Silver Lake Road. <br /> Motion by Councilman Sundland, seconded by Councilman Sauer to approve the <br /> parking layout and landscaping plans for the Herfurth Real Estate Office with <br /> stipulation of 12 parking spaces; 25 ft. curb cut; 17 feet of greenery on the <br />
