• RESOLUTION 77-056 <br /> RESOLUTION AUTHORIZING PARTICIPATION IN THE <br /> SUBURBAN HEALTH NURSING SERVICE; DIRECTING THE EXECUTION AND <br /> DELIVERY OF A JOINT POWERS AGREEMENT; AND DESIGNATING <br /> A REPRESENTATIVE OF THE CITY AS ITS MEMBER ON THE <br /> SUBURBAN HEALTH NURSING SERVICE <br /> Motion carried unanimously. <br /> Dick Letourneau reported actions taken and recommendations made by the <br /> Planning Board during their November 15 , 1977 meeting as reflected in <br /> the minutes for that meeting. <br /> pr <br /> Included was the" Board's recommendation that Peter S. Cartwright be grant- <br /> ed the Variance to the City Zoning Ordinance which will allow him to <br /> extend the basement under the existing sun deck on his home at 3423 <br /> Maplewood Drive to within a foot of his property line. <br /> Mr. Cartwright was present and reiterated the arguments he had made in <br /> his memos of November 7th and 17th which he felt justified the proposed <br /> expansion for living space in his basement. These included three teen- <br /> agers in the family who require more bedroom and recreational space <br /> than provided in his existing living space which only has a bath and a <br /> half and a tuck-in garage which limits expansion alternatives in the <br /> lower level. <br /> • He explained how the error in the original lot survey of his property <br /> which had resulted in his sun deck encroaching beyond his lot line had <br /> been discovered and said he plans to modify the deck when it is replaced <br /> over the new addition. <br /> Councilman Haik said she was upset with reports that Mr. Cartwright had <br /> been given permission to put in the foundations for the addition before <br /> the new survey was made and she corrected the conjecture that only a <br /> garage was on the side of the Shelstad home which is 14 feet from the <br /> Cartwright property line by saying there is also a family room on that <br /> side. <br /> Councilman Sundland also questioned why, after the error was discovered <br /> in the plat the City had on record, Mr. Cartwirght was given permission <br /> to have the footings and floor for the proposed addition installed be- <br /> fore the new survey was made. He felt Mr. Cartwright had been "given <br /> poor advice when told to go ahead with the foundations" but was opposed <br /> to setting a precedent for "one foot structure variances" . He also <br /> said that, inspite of Mr. Cartwright's assurance that he did not intend <br /> to enclose the sun deck, restrictions against such actions might be <br /> forgotten or overlooked in the City' s files if a future owner of the <br /> property should decide to add another room to the home. <br /> The Manager suggested the possibility of placing a restrictive covenant <br /> on the title to the property, where it would be known to all prospective <br /> property purchasers. <br /> (2) <br /> I <br /> i <br />
