• <br /> The Executive Committee feels that it is necessary to retain a consultant to assist in <br /> the development of an affirmative action plan, at least in its initial stages. As <br /> discussed on November 16th, a request for proposals has been prepared to <br /> determine which consultants may be interested and available. The Executive <br /> Committee will interview all consultants who express such an interest on Thursday, <br /> November 30th. At that time it will select a consultant for recommendation to those <br /> communities which choose to cooperate in a joint affirmative action effort. <br /> It should be noted that some information must be developed for submission to the <br /> Court by December i�11h. T he E%ecuti v c C ommittee :^-1111 cont.-act .;rth the sl-lcctcd <br /> consultant Qnly to produce such information and only to prepare a comprehensive <br /> proposal for submission to the full group. The Executive Committee will not <br /> commit to any other services. <br /> Minority Hiring Commitment <br /> Judge Solum's order requires a minority hiring commitment by the defendant <br /> • communities, unless these communities are willing to pay a 5300,000 statutory <br /> penalty. The Executive Committee feels that we should attempt to establish a hiring <br /> commitment which is acceptable to Judge Solum. It is the Committee's assumption <br /> that the successful attainment of a minority hiring goal would end the Court's <br /> continuing jurisdiction in this case. <br /> The Executive Committee feels that any hiring commitment must be based upon <br /> both the number of minority applicants who test with the defendant communities <br /> and upon the number of entry-level law enforcement positions which are filled in <br /> these communities. The hiring goal would be the relevant percentage of minority <br /> applicants multiplied by the number of positions which are filled over a given period <br /> of time. The Committee does not feel that a fixed number of minority hirings should <br /> be our goal, nor should our goal be based upon the percentage of minorities in the <br /> metropolitan area. It also is hoped that any hiring goal can be limited to the hires <br /> which occur, and not to retention statistics or to a percentage of officers actually <br /> employed at any point in time. <br /> Allocation of Damages <br /> The Executive Committee hopes that all communities which are involved in this <br /> lawsuit will be able to agree to a formula for the allocation of damages. If this is not <br /> • the case, significant additional expense, confusion and legal action could result. <br />
