• Lease Agreement <br /> g went <br /> Page 6 <br /> structurally unsound for Tenant's use, including but not limited to consideration of age <br /> of the structure, damage or destruction of all or part of the Property from any source, <br /> or factors relating to condition of the Property; or by Landlord if it determines in its <br /> sole discretion that continued occupancy of Property by Tenant is in fact a threat to <br /> health, safety or welfare. <br /> Upon termination of this Lease for any reason, Tenant shall remove its equipment, <br /> personal property, Antenna Facilities, and leasehold improvements from the Property <br /> within thirty (30) days of the date of termination, and shall repair any damage to the <br /> Property caused by such equipment, normal wear and tear excepted; all at Tenant's <br /> sold cost and expense. Any such property or facilities which are not removed by the <br /> end of lease period shall become the property of the Landlord. <br /> 15. liquidated Damages• Early Termination Notice of Tenant's early termination shall be <br /> given to Landlord in writing by certified mail, return receipt requested, and shall be <br /> effective upon receipt of such notice. All rentals paid for the lease of the Property <br /> prior to said termination date shall be retained by Landlord. Upon such termination, <br /> • this Lease shall become null and void and the parties shall have no further obligations <br /> to each other, except that rental payments to the Landlord shall continue as liquidated <br /> damages for the remainder of the five (5) year Lease term, not to exceed 150% of the <br /> annual rent for the year in which such termination occurs. <br /> 16. Limitation of Landlord's Liability: Early Termination In the event Landlord <br /> terminates or otherwise revokes the Lease, other than as provided in paragraph 14 <br /> above, or Landlord causes interruption of the business of Tenant, Landlord's liability <br /> for damages to Tenant shall be limited to the actual and direct costs of equipment <br /> removal, relocation or repair and shall specifically exclude any recovery for value of <br /> the business of Tenant as a going concern, future expectation of profits, loss of <br /> business or profit or related damages to Tenant. <br /> 17. Letter of Credit/Security Fund Tenant shall provide a $5,000 Letter of Credit or <br /> Security Fund payable to Landlord upon demand to secure compliance with the <br /> provisions of this Lease, including but not limited to the requirement that Tenant <br /> remove all equipment and Antennae Facilities in the event of expiration or termination. <br /> 18. Insurance. <br /> a. Tenant shall carry adequate insurance to protect the parties against any and all <br /> • claims, demands, actions,judgments, expenses, and liabilities which may arise <br /> out of or result directly or indirectly from Tenant's use of the Property.
