• <br /> MEMORANDUM <br /> DATE: May 21, 1996 <br /> TO: Mayor and Councilmembers <br /> FROM: Michael Mornson, City Manager <br /> ITEM: RECOMMENDED CHANGES TO THE CITY CODE <br /> RELATING TO CONDITIONAL USE PERMITS <br /> As a result of a request from a church to locate in Apache Plaza, the Council directed the <br /> Planning Commission to review the existing conditional use permit regulations to determine if <br /> they are appropriate for certain districts. The Planning Commission also recommended some <br /> changes that permitted uses be changed to conditional use permit uses in a C, commercial <br /> • district. <br /> I spoke with City Attorney Bill Soth about these changes and he has no problem with them. It <br /> is really a policy, not a legal issue on whether libraries should be allowed in an R-1 residential <br /> district. <br /> Some of the major changes the Planning Commission recommends are as follows: <br /> • Libraries be deleted as a conditional use permitted in an R-1 residential district. <br /> • Churches, auctions and pool halls be deleted as conditional uses permitted in a C, <br /> commercial district. <br /> • Car washes be moved from a permitted use to a conditional use in a C, commercial <br /> district. <br /> • Motor cycle sales be deleted as a conditional use in a C, commercial district. <br /> Once the Council is in agreement on various changes, we would then put an ordinance <br /> amendment together for a fust reading. <br /> • <br />
