4. The agency ' s existing terminal (s) , if any, are automatically <br /> • "grandfathered" into the CJDN. <br /> 5. All terminals allocated to the agency beyond the number to <br /> be paid by DPS will be billed in full to the agency. <br /> 6. All maintenance costs for terminals over and above that <br /> provided for within state terminal equipment contracts will be paid <br /> by the agency. <br /> 7. Terminal installation, delivery and relocation charges will <br /> be paid by the agency. <br /> B. If the agency is an instrumentality of the state or federal <br /> government, it will be billed in full for terminal and associated <br /> equipment costs for participation in the CJDN. <br /> 9. If the agency has computer-to-computer interfaces, DPS will <br /> pay only for the expense of line and modem costs between the state and <br /> • agency computers. <br /> 10. If the agency has terminal equipment contracts in effect with <br /> private vendors on November 1, 1977 , it will be reimbursed for actual <br /> terminal costs by DPS upon submitting proof of payment for such costs. <br /> 11. Only authorized terminals and associated equipment provided <br /> by DPS may be connected directly to the CJDN by the agency. (Note: This <br /> does not include terminal equipment located on the agency' s end of <br /> computer-to-computer interfaces between the state and agency computers . ) <br /> 12. The agency shall execute and have in effect with DPS a current <br /> "Criminal History Record Security and Privacy Agreement" . <br /> 13. Agency terminal allocations beyond those existing on the <br /> CJDN as of November 1, 1977 may be added to the network only with <br /> • the express written permission of DPS. <br /> 14 . Any amendments to this agreement shall be in writing and <br /> executed by both DPS and the agency. <br />
