-2- <br /> • <br /> WHEREAS, paragraph 6.5 Was amended on June 19, 1990, and now provides <br /> that: <br /> The contract dollar amount for this Contract for Task 1 and 2 as <br /> described in Part 4.6 of this contract shall not exceed seventy-three <br /> thousand nine hundred dollars ($73,900) . This contract may be amended <br /> to increase the total funding for Operation and Maintenance as provided <br /> for in Task 3 of Part 4.6 of this contract for the shakedown year of the <br /> Extended RA; and <br /> WHEREAS, the purchase of a standby generator requires additional costs; <br /> and <br /> WHEREAS, the City has completed Tasks 1 and 2 at a total cost of <br /> $57,961. <br /> NOW THEREFORE IT IS AGREED BY AND BETWEEN THE PARTIES HERETO: <br /> 1. Paragraph 4.6 shall be amended to include Task 4. <br /> • Task 4. Standby Generator. <br /> The City shall purchase a standby generator to be used only in periods <br /> of electrical power outages, to provide electrical power that will <br /> enable the pumps to lift water to the elevated storage tank. The City <br /> shall solicit bids for a generator that provides sufficient capacity to <br /> operate one high service pump, serving the water towers. <br /> The City, as part of the Remedial Action project, shall be reimbursed at <br /> a cost not to exceed $35,000.00 for the purchase of a generator. This <br /> cost will be paid out of the Remedial Action construction funds which <br /> are 90 percent federal, and 10 percent state Superfund funds. <br /> 2. Paragraph 6.5 shall be amended to read: <br /> The contractor dollar amount of this contract for Tasks 1 and 2 as <br /> described in Part 4. 6 of this contract shall not exceed fifty-seven <br /> thousand nine hundred sixty-one dollars ( $57,961 ) . For Task 4 as <br /> described in para. 4.6 this contract shall not exceed thirty-five <br /> thousand dollars ($35,000) . The total contract dollar amount for <br /> Tasks 1, 2, and 4 shall not exceed ninety-two thousand nine hundred <br /> sixty-one dollars ($92,961 ) . <br /> 3. Paragraph 17.0 shall be amended to iliclude the following: <br /> In using the generator the City shall comply with all the requirements <br /> of 40 CFR Part 35 subpart 0 pertaining to the acquisition, use and <br /> • disposal of equipment at CERLA sites. <br /> 4. Except as herein amended, the provisions of the original agreement <br /> remain in full force and effect. <br />
