For purposes of this Lease, "Consumer Price Index" or "CPI" <br /> means the Consumer Price Index for All Urban Consumers, Minneapolis-St. Paul, <br /> Minnesota-Wisconsin, All items (1982-84 = 100), as promulgated by the Bureau of <br /> Labor Statistics of the United States Department of Labor. If a substantial change is <br /> made in the method of establishing the CPI, the CPI will be appropriately adjusted to <br /> a figure that would have resulted had no such change occurred. If the CPI is not <br /> available, a reliable governmental or other non-partisan publication establishing a <br /> comparable index selected by Lessor will be used. <br /> (d) At the request of either, Lessor and Lessee will execute and <br /> deliver appropriate documents covering extension of the term, the new monthly <br /> rent and other terms of the Lease during the extended term. <br /> 22. WATER. <br /> Lessee agrees to pay for all water used in the operation of dishwashers, <br /> refrigeration used on the Leased Premises at the same rates charged by the Water <br /> Department of the City of St. Anthony, Minnesota. <br /> 23. VACATION OF PREMISES. <br /> • Lessee, upon leaving the Leased Premises, shall at its own expense <br /> remove all ashes, dirt, rubbish and refuse, and upon Lessee's failure to do so, Lessor <br /> may immediately without further notice to Lessee do the same at Lessee's expense, <br /> which Lessee shall immediately pay upon receipt of a bill for same from Lessor. <br /> Any holding over by Lessee after the expiration of this Lease or any <br /> renewal thereof shall be deemed a month-to-month tenancy with rental set at one <br /> and one-half times the level provided for herein. <br /> Lessee agrees that no assent, express or implied, by the Lessor to any <br /> breach of any of Lessee's covenants or agreements shall be deemed or taken to be a <br /> waiver of any succeeding breach of such covenant. <br /> 24. KITCHEN AND RESTAURANT EOUII'MENT. <br /> Lessor shall to lease to Lessee during the term of this Lease and any <br /> renewal hereof, the kitchen and restaurant equipment described on Exhibit B <br /> attached hereto and made a part hereof (the "Restaurant Equipment") AS-IS, <br /> without any representations or warranties. Lessee has fully inspected the <br /> Restaurant Equipment, and acknowledges that the same is in good condition and <br /> repair. Lessee shall pay to Lessor, as additional rent for the lease of the Restaurant <br /> Equipment, the amount of One Hundred and No/100ths Dollars ($100.00) on <br /> • -12- <br />
