CITY OF ST. ANTHONY <br /> RESOLUTION 12-015 <br /> RESOLUTION TO APPROVE A VARIANCE TO THE SIGN ORDINANCE <br /> TO ALLOW A SECOND IDENTIFICATION SIGN FOR <br /> HENNEPIN COUNTY MEDICAL CLINIC <br /> AT THE MARKET PLACE SHOPPING CENTER <br /> WHEREAS, Mr. Richard Lang of Visual Communications contacted City staff advising <br /> them that Hennepin County Medical Clinic is locating at the Market Place <br /> Shopping Center and wanted to discuss the need for a second identification <br /> sign; and <br /> WHEREAS, Staff advised Mr. Lang that City Ordinance §155.29 (B) (1) allows only one <br /> identification sign; and <br /> WHEREAS, Mr. Lang, as the representative for Hennepin County Medical Clinic <br /> applied for a variance to the City's Sign Ordinance to allow for a second <br /> identification sign; and <br /> WHEREAS, the Planning Commission held a public hearing on the variance request on <br /> December 20, 2011; and <br /> WHEREAS, The Planning Commission determined that the Hennepin County Medical <br /> Clinic's request for a variance to the sign ordinance to allow a second <br /> business identification sign has met the criteria as specified in the City <br /> Code's Zoning Ordinance, §152.245 (C) which states that no variance will <br /> be granted unless evidence presented supports that strict enforcement of the <br /> City Ordinance would cause practical difficulties for the applicant. <br /> 1. The property cannot be put to a reasonable use without the <br /> variance due to the architecture in the planned unit development; <br /> 2. That the circumstances causing the practical difficulty were not <br /> created by the tenant; <br /> 3. That the variance, if granted, will not alter the essential <br /> characteristics of the locality; <br /> 4. That economic considerations alone are not the basis for the <br /> practical difficulty; <br /> 5. That the circumstances causing the practical difficulty are <br /> unique to the individual lot; and <br /> 6. The granting of the variance is in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Land Use Plan. <br />
