ANTHONY
"• COUNCIL MINUTES
February 12, 1974
The meeting was called to order by Mayor Miedtke at 7:30 P.M.
Present at roll call: Haik, Sauer, Sundland, Miedtke, Stauffer
Also present: Jerry Dulgar, City Manager
Larry Vickrey, City Attorney
Jim Fornell, Adm. Asst.
The following corrections were made to the Council minutes of January 22,1974:
Page 1, para. 4: "City Attorney was directed. . . ." is to be incorporated
into the motion by Mayor Miedtke regarding elections on odd numbered years.
Motion by Councilman Haik, seconded by Councilman Sauer to approve the minutes as
corrected.
Motion carried.
Mr. Vickrey read an opinion from the Minnesota Municipalities Magazine indicating
that there will probably be clarifying legislation enacted this year regarding
• election regulations.
After Mr. Fornell had reported on the progress being made by the Planning Board
on the updating of the zoning ordinance, the Planning Board minutes on the
special meeting of January 29th, 1974 were ordered filed.
Councilman Haik expressed an opinion that the City of St. Anthony should not
participate in the appeal of the ruling in the lawsuit against Metro Sewer Board
regarding SAC charges. She felt that in terms of value to the city it didn't
seem necessary to continue participation in the lawsuit but rather we should let
the legislators know the Council's objections to the SAC charge.
Mayor Miedtke indicated that he felt that joining in the appeal of the ruling was
necessary because of the precedent that would be set by allowing the metropolitan
commission to go beyond the scope of their legislative authority. ._
Motion by Councilman Haik, seconded by Councilman Stauffer that the City of St.
Anthony cease participation in the SAC lawsuit and appeal.
Voting on the motion:
Aye: Haik and Stauffer
Nay: Sundland, Sauer, Miedtke
Motion not carried.
Motion by Councilman Sundland, seconded by Councilman Sauer to authorize the
City of St. Anthony's participation in the appeal against the ruling in the SAC
lawsuit and pay the charge of $530.00 for participation on the basis of formula.
Motion carried.
