CITY OF ST. ANTHONY <br /> "• COUNCIL MINUTES <br /> February 12, 1974 <br /> The meeting was called to order by Mayor Miedtke at 7:30 P.M. <br /> Present at roll call: Haik, Sauer, Sundland, Miedtke, Stauffer <br /> Also present: Jerry Dulgar, City Manager <br /> Larry Vickrey, City Attorney <br /> Jim Fornell, Adm. Asst. <br /> The following corrections were made to the Council minutes of January 22,1974: <br /> Page 1, para. 4: "City Attorney was directed. . . ." is to be incorporated <br /> into the motion by Mayor Miedtke regarding elections on odd numbered years. <br /> Motion by Councilman Haik, seconded by Councilman Sauer to approve the minutes as <br /> corrected. <br /> Motion carried. <br /> Mr. Vickrey read an opinion from the Minnesota Municipalities Magazine indicating <br /> that there will probably be clarifying legislation enacted this year regarding <br /> • election regulations. <br /> After Mr. Fornell had reported on the progress being made by the Planning Board <br /> on the updating of the zoning ordinance, the Planning Board minutes on the <br /> special meeting of January 29th, 1974 were ordered filed. <br /> Councilman Haik expressed an opinion that the City of St. Anthony should not <br /> participate in the appeal of the ruling in the lawsuit against Metro Sewer Board <br /> regarding SAC charges. She felt that in terms of value to the city it didn't <br /> seem necessary to continue participation in the lawsuit but rather we should let <br /> the legislators know the Council's objections to the SAC charge. <br /> Mayor Miedtke indicated that he felt that joining in the appeal of the ruling was <br /> necessary because of the precedent that would be set by allowing the metropolitan <br /> commission to go beyond the scope of their legislative authority. ._ <br /> Motion by Councilman Haik, seconded by Councilman Stauffer that the City of St. <br /> Anthony cease participation in the SAC lawsuit and appeal. <br /> Voting on the motion: <br /> Aye: Haik and Stauffer <br /> Nay: Sundland, Sauer, Miedtke <br /> Motion not carried. <br /> Motion by Councilman Sundland, seconded by Councilman Sauer to authorize the <br /> City of St. Anthony's participation in the appeal against the ruling in the SAC <br /> lawsuit and pay the charge of $530.00 for participation on the basis of formula. <br /> Motion carried. <br />
