CITY OF ST. ANTHONY COUNCIL MINUTES • June 25, 1974 The meeting was called to order at 7:33 P.M. by Councilman Stauffer, Chairman Pro Tem. The following were present for roll call: Haik, Sauer, Stauffer Absent: Miedtke, Sundland Also present: Jerry Dulgar, City Manager Larry Vickrey, City Attorney Jim Fornell, Adm. Asst. Motion by Councilman Haik, seconded by Councilman Sauer to approve the minutes of the June 4, 1974 Special Council meeting. Motion carried. The following amendment was made to the minutes of the June 11, 1974 meeting: Page 6-last paragraph: Add ". . . .and with the balance coming from the Insurance Rebate Fund". Motion by Councilman Sauer, seconded by Councilman Haik to approve the minutes of the June 11, 1974 meeting as amended. • Motion carried. Mr. George Marks presented the recommendations of the Planning Board at their meeting June 18, 1974. In his report on the request for a lot size variance to allow Mr. Phillip Sularz to build an addition to his home at 2524 St. Anthony Boulevard, Mr. Marks pointed out that Mr. Sularz had lived in the home for 22 years and the protesting neighbors, Mr. & Mrs. John Thorin, 2528 St. Anthony Boulevard, had moved to their home shortly after the Sularz home had been built and some of the Board members felt Mr. Sularz should not now be penalized for adding to a building which had met the building regulations of the time it was constructed. However, the Board recommended by a 3 to 2 vote to deny the request for the addition of the room to the front of the Sularz home. Mr. Dulgar pointed out that the request was for a side yard lot size variance and I not for a conditional use permit as indicated in the Board's minutes of the meeting. Mr. & Mrs. Thorin were present and represented by counsel, Mr. G. Robert Johnson, 2300 Central Avenue N.E. , who repeated the "strenuous objections" he had voiced for his clients to the addition at the Board meeting and told the Council that he did not feel Mr. Sularz, who did not attend the Council meeting, intended to "fight tooth and nail" for the addition but only sought the opinion of the Board of the addition. Motion by Councilman Sauer, seconded by Councilman Haik to follow the recomm- endations of the Planning Board and deny the request of Mr. Phillip Sularz for a lot size variance of 5 feet side yard to allow the addition of a room to the front of his home on Lot 17, Block 5, Murray Heights Addition. \Motion carried.
