-2-
Motion carried unanimously.
• Ze meeting was recessed at 7:55 and resumed at 8:00 P.M. for a Public Hearing
on the Wm. Flaherty request for a variance he needed to build a swimming pool
on his property.
Mr. Flaherty said he was applying for a side yard variance of 5 feet to construct
a swimming pool at the southerly edge of his residence at 3208 Rankin Road. Mr.
Dulgar said he had a letter from the Salem Covenant church indicating they
would offer no opposition to the plan since the residence at 3200 Rankin Road,
which they owned, was at least 33 feet'away from the proposed structure.
No one else appeared to either speak for or against the proposal and the Public
Hearing was closed at 8:05 P.M.
The City Attorney read that section of the City Ordinances from which Mr.
Flaherty was seeking a variance and Councilman Sundland said he felt the request
could be considered unique because of the large amount of sideyard setback of the
adjoining residence.
Mr. Letourneau and Mr. Rymarchick of the Planning Board were present and the
former said the Board had indicated some reticence to setting a precedent by
granting such a variance. The Mayor indicated he was opposed to granting any
such variances.
Motion by Councilman Sundland, seconded by Councilman Stauffer to grant a side
yard variance of 5 feet to Mr. Wm. Flaherty to allow him to construct the
• swimming pool on his property at 3208 Rankin Road, feeling the request was
unique because of the amount of undeveloped land between the Flaherty residence
and the house on the adjoining lot.
Voting on the motion:
Aye: Haik, Sauer, Sundland, Stauffer
Nay: Miedtke
Motion carried.
\ion by Councilman Stauffer seconded by Councilman Sundland to authorize ut rize the
Manager to negotiate an insurance package.
Motion carried unanimously.
The Manager told the Council the maximum number of subsidized units which had
been alloted the City under the rent subsidy program and Mr. Fornell explained
which units might qualify for and which owners had indicated a willingness to
participate in the program.
Mrs. Marie Michaelhoff, owner of the undeveloped lot at the southwest corner of
Silver Lake Road and 37th Avenue N.F. , requested she be allowed to sell flowers
at that spot the weekends of Mothers Day, Memorial Day and Fathers Day and
disputed some of the points presented by the Manager in his recommendation for
denial of the request. Among these was her assertion that traffic control
would be provided during the sale.
Several Council members voiced their opposition to allowing vehicles to cross
the walkways along the Silver Lake Road side of the property. Previous problems
with traffic pile-up at the Fas Gas station on the opposite corner of Silver
Lake Road as well as the number of times the City has refused similar requests
