• of residents with the necessary expertise to provide input to the City's <br /> health officer and the medical center was discussed. <br /> The meeting was recessed from 8 :45 to 9 :05 when it was reconvened to <br /> hear I.C. Comstock, City Engineer, discuss the problems he is having <br /> trying to get information specific enough to present as Change Order <br /> #2 for Street Improvement Project 1976-1. Mr. Comstock told of the <br /> difficulties he has encountered in attempting to get the necessary <br /> documentation from the contractor, Dunkley Surfacing Company which will <br /> justify the contractor's request for payment for work not covered by <br /> the contract or Change Order #1. The Engineer said the documents which <br /> are attached to his February 17th memorandum to the Council comprised <br /> the contractor' s submittal for what he considers to be a partially <br /> valid change order which Mr. Comstock said he feels could probably be <br /> legally upheld. He therefore was requesting that the Council give <br /> specific reaction to the itemization of separate invoices Number 1 <br /> through 13 so he could base his approval or disapproval of the charges <br /> on their directions . <br /> The Mayor said he was opposed to the Council being forced to make judg- <br /> ments on all the documents which had been presented feeling the Engineer <br /> should get a specific change order from the contractor on which he <br /> could make a recommendation to the Council with a specific delineation <br /> of those items which the Engineer recognized as ligitimately belonging <br /> in the change order. <br /> • Councilman Haik and Sundland were of the opinion that each item could <br /> be considered individually so some reasonable judgment could be made <br /> by the Council inview of the Engineer's insistance that he is unable to <br /> secure specific documentation and justification for a change order from <br /> the contractor. <br /> When Councilman Stauffer asked the Attorney what he would suggest the <br /> best method of getting the needed information might be, he replied that <br /> the Council could indicate either approval or disapproval of each item <br /> submitted to them which would probably force the contractor to "prove <br /> up" any item for which they had indicated disapproval . <br /> Motion by Mayor Miedtke and seconded by Councilman Stauffer to table <br /> action on Change Order #2 for Street Improvement Project 1976-1 until <br /> the next Council meeting in which time the Manager is to contact the <br /> contractor to attempt to get from him a specific request for payment <br /> in a logical and justifiable form for review by the City Engineer. <br /> Motion carried unanimously. <br /> Mr. Comstock left at 9 :30 P.M. <br /> The January Police Report was filed. <br /> Councilman Stauffer discussed her report on the first meeting of the <br /> • Task Force formed by the City Council to study the problems of Chemical <br /> Dependency. <br /> (5) <br />
