� l <br /> ( 1992, as may be amended) , CITY agrees that it will defend and <br /> hold the COUNTY, its elected officials, officers, agents, <br /> employees and duly authorized volunteers harmless from any and <br /> all liability (statutory or otherwise) claims, suits, damages, <br /> judgments, interest, costs or expenses (including reasonable <br /> attorney's fees, witness fees and disbursements incurred in the <br /> defense thereof) resulting from or caused by any act or omission <br /> of the CITY, its officers, agents, contractors, employees or duly <br /> authorized volunteers in the performance of the responsibilities <br /> provided by this Agreement. The COUNTY agrees to promptly notify <br /> the CITY whenever the COUNTY receives written notification of a <br /> claim or threat or initiation of an action arising from or <br /> relating to the subject matter of this paragraph 8 .A. <br /> 8 .B. Nothing in the contract documents shall be <br /> • construed as or operate as waivers of the COUNTY's statutory or <br /> common law immunities or limitations of liability. However, <br /> consistent with the foregoing, the COUNTY's liability obligations <br /> shall be as follows: consistent with the specific limits, <br /> exclusions and conditions expressed in Minnesota Statutes Chapter <br /> 466 ( 1992, as may be amended) , the COUNTY agrees to hold the <br /> CITY, its officers and employees, harmless from any and all <br /> claims and liability with respect to bodily injury or property <br /> damage to the extent the same results directly or indirectly from <br /> any negligent act or omission of the COUNTY, its agents and <br /> employees. The CITY agrees to promptly notify the COUNTY in <br /> writing whenever the CITY receives written notification of a <br /> claim or a threat or initiation of an action arising from or <br /> • relating to the subject matter of this paragraph 8 .B. <br /> (6 ) <br />
