9 . Except as otherwise provided in paragraphs 7 .B. , <br /> • 7 .C.• and 8 .B. hereof, the COUNTY's liability hereunder shall be <br /> as follows: <br /> The COUNTY shall endeavor to perform all services called <br /> for herein in an efficient manner. The sole and exclusive <br /> remedies for any breach of this Agreement by the COUNTY and for <br /> COUNTY's liability of any kind whatsoever, including but not <br /> limited to liability for negligence with respect to the services <br /> hereunder, shall be limited to correcting diligently any <br /> deficiency in said services as is reasonably possible under the <br /> pertinent circumstances . In no event shall the COUNTY be liable <br /> for actual, direct, special, incidental, or consequential damages <br /> or for any business or financial loss whatsoever. <br /> 10 . Neither party hereto shall be deemed to be in <br /> default of any provision of this Agreement, or for delay or <br /> failure in performance, resulting from causes beyond the <br /> reasonable control of such party, which causes shall include, but <br /> are not limited to, acts of God, labor disputes, acts of civil or <br /> military authority, fire, civil disturbance, changes in laws, <br /> ordinances or regulations which materially affect the provisions <br /> hereof, or any other causes beyond the parties ' reasonable <br /> control. <br /> 11. This Agreement shall commence on August 1, 1994, <br /> and shall terminate on July 31, 1998 . This Agreement may be <br /> extended for a term of four (4) years by either party giving the <br /> other written notice of its intent to so extend no less than 150 <br /> • days prior to the termination of this Agreement.
